View Full Version : Help.I was denied but I would like to reapply

I provided sufficient evidence for all the requirements except for my 5 year residency. I was denied DACA for what I believe is not submitting sufficient evidence proving my stay in the years 2011 and 2012 .I sent in a letter from a religious institution claiming I volunteered and participated in their events on 2011 and 2012 for which I had no evidence aside from word of mouth. Recently I discovered invoices on an Amazon and Paypal account that I believe is concrete evidence of my residency. The only thing is that having been denied im not entirely sure of my options.

Are there any options left for someone who has been denied?What are some possible solutions besides waiting for the next bill? haha I know this is a public forum but any insightful voice will be appreciated. Thank you

You can reapply. Did you receive a RFE? Or did they straight up deny you?

I received an RFE. On the denial notice they sent me it says "You may not file an appeal or motion to reopen/reconsider this decision." I'm assuming
this decision only affects this particular case and if i were to reapply with new evidence a new decision can be made regardless of the denial.

this decision only affects this particular case and if i were to reapply with new evidence a new decision can be made regardless of the denial.

Yeah you start a new case but you will need to pay the 465 something it I again

I think u should reapply.. this time submit all ur evidence also get friends and family 2 write letters stating how long they know u and different events u participated in with them. If u get approve 4 this u know u will get approved for CIR whenever it becomes a law. What was ur time line

I think this is why it's better to apply once you've gathered all the evidence. There's another person on this forum who started looking for more evidence AFTER they got a REF. You are supposed to do all that before you apply. That's one of the reasons I haven't applied.

Now you mentioned that as proof you sent a letter from a church and that was not enough??

On the official website it says the following:
Official records from a religious entity confirming participation in a religious ceremony.

Could you post what else you sent? Also, did they specifically say you got denied because of that year gap?? 2011 to 2012? So that means, you didn't have enough proof to show you were present when DACA was announced? Maybe that's why you got denied?

Once you are denied you can't reapply. The instructions are very clear.

Yeah I do not think you can reapply at all. Since you already got denied. Hopefully CIR passes very soon so you can get approved then!

That wasn't enough concrete evidence. It was all "word of mouth" evidence.

Nowhere in the instructions does it say you can't reapply. What it does say is that you can not file a motion to reconsider a denial, unless the denial was USCIS fault.

You can reapply if you meet the requirements and if you have more evidence to show. This was answered in one of the USCIS press conference about DACA.

^Yes, but before you hurry and send everything in....do try and look for more evidence. :)

What I did is as soon as DACA was announced I started looking for my evidence and saving the money too. lol Good luck! :)

What was the letter like? Most of my brothers evidence consisted of affidavits becuase he had so many gaps and little evidence. He always worked for cash, had ZERO credit, no netflix, no NADA.

The lawyer prepared the affidavit letter. My brother asked family friends and our landlord to sign them along with a scanned copy of their CA ID. And he was approved two months after his app was received.

I send online highschool diplomas �� i didnt send enough evidence from 2007 thru now now, im taking GED clases and i send proof of every single month

so you committed fraud? by sending online high school diplomas? wut...

if you did have an "online" high school diploma, why would you be taking a GED class

if you did commit fraud, then that's probably why you got denied.

Did you visit a dentist or optometrist? Bank statements?

Btw, what helped my case a lot was visiting the dentist once a year for teeth cleaning, it accounted for my presence here by about 4-5 years.

if you did have an "online" high school diploma, why would you be taking a GED class

if you did commit fraud, then that's probably why you got denied.

No it could mean that the school is not accredited to their standards. There are many alternative home schooling programs out there.

Hi, I also did online diploma and sent it to USCIS. I'm still waiting for my answer from them. I also had final order of deportation .

What online HS diploma did you send? I used Lincoin Academy online diploma. It say's it accridited any community colleges in US. So I dont know, any suggestion?

I send my app in Sept 06 2012 and still waiting.

I did private home schooling I did the "marque learning center"in houston Texas. It's a accreditation program they are nationally accredited by National Private Schools Accreditation Group. My classes weren't online they were paper work I had to take home and work on.
I'm still waiting as well from uscis to give me a decision. I think that's why they are taking long because they are investagating my high school diploma.

What kinda online diploma was it? What is it called? And is it a private school or home school diploma? Because mines wasn't online i did home school it's called "marque learning center" I got all of the laws from Texas about home school and the accreditation from this program here it is. So I should be good to go right?
