He can not apply for DACA. Hiring a lawyer is pointless and a waste of money. He reentered when he was 23 after being being gone for 10+ years. He doesn't even meet the bare minimum requirements.
Even though he's attending a GED program doesn't matter, he was gone for 10+ ... because of his age the only proof he can show is school records(when he first came and had he never left) which he doesn't have.
Be honest with him, you'll be doing him a serious disservice if you let him waste time with a lawyer(hire or consulting).

He does not qualify, his departure was not short and brief, it was 13 years!!

The adjudicators aren't stupid. What would a 10 year old kid be doing for 13 years unaccounted for in the U.S? He was supposed to be in school for at least 9 of those years, and have an immunization record at least. It's too big of a gap.

Any supporting documentation he sends trying to prove his presence during that period, would be fraudulent. He's better off waiting to see if anything comes of CIR next year.

I was almost sure he wouldnt qualify. Because like JJ said that was not a brief departure. But I did not want to tell him straight out. So nxt time I talk to him with all do respect I will tell him.

They'll more than likely issue an RFE and he will be denied afterwards.He doesn't qualify because he doesn't technically meet the under 16 requirement during the last time he entered !

Yeah, just tell him that they would more than likely ask for documentation showing where he was for those 13 years because he was supposed to be in school, and that is where he wouldn't have anything to show.

If he told them the truth that he was gone for 13 years and re-entered at 23 years old, they would probably deny him right away.

I wouldn't risk it. Tell him to be patient until next year for the events of CIR.

Not fraud, it's an idiot we're dealing with in this case. He'll get what's coming to him.

I hate these types of cases. He technically entered before 16 but exited. He is not interrupting continuous residence of 2007-2012. The only thing is the Graduation from a High School requirements. It is a huge as gap he basicallydidn't finish elementary, jr high or high school here. He basically enrolled in the GED program for DACA. I think they are lenient on people receiving GED's but only if they have some high school and just quit for some harsh reason. I think Dream alive had a similar case that he is still working on his GED because he had to drop out of high school. But, he did receive an RFE I wouldn't risk it.

The other issue might be the page that asks you the places you have lived at since you arrived in the Country.

I might he would have to put

92 address
2007 address.
