Hmmm....I thought permanent residency (10 year) was predicated on the 2 year anniversary of a marriage at the time of interview? Unless I am mistaken.

You should apply during the 90 days before your second anniversary as a conditional resident. The expiration date on your green card is also the date of your second anniversary as a conditional resident.

Idk? What I've read is that if you have been married less than 2yrs than you get the 2yr conditional green card, but if you've been married for atleast 2 yrs and above then you can get the 10yr green card. I know I will get the 2 yr conditional green card because I've only been married for 9 months.

Osito is correct. You will receive a 10 year Green Card and will be eligible for citizenship very soon.

What documents are usually asked for at the interview based on marriage? I'm trying to prepare everything, I don't like to wait last minute.

Re: DACA to AOS

I found this statistic interesting. Over 5000 DACA applicants have applied for permanent residency so far, and over half have been approved.

For the purpose of documentation, you don't prepare documents for the interview...but for the application. You must prove the relationship is bona fide. I believe the following links might explain better.

Right, but I am highlighting that your CR-1 visa can have its conditions removed 90 days before second year of your CR-1 conditional status.

Osito 08-01-2016 11:58 AM

Re: DACA to AOS

second anniversary of getting the conditional residency not second year of marriage. so if you're married for 1 year and 11 months when you get AOS, you'll get 2 year conditional card. You can apply to get conditions removed at 3 months before 2 year anniversary of being granted card (so 3 years 8 months of being married).

It can be beneficial to just wait to AOS if you're close to the two year mark and are covered by DACA during that time. I've only been married for a year and 4 months but my DACA expired in september so might as well AOS now and do the removal of conditions in two years.

Re: DACA to AOS

You send copies of everything for the application, but bring in the originals (and more copies) during the interview. I brought a bunch of pictures, his and my original birth certificates, and marriage certificate. The officer also asked for any extra proof or new proof that wasn't submitted - like we bought a car in between the time we sent the application and our interview so we included a copy of those documents. They may retain the copies of things like leases, titles, bills, retirement/bank statements, so make sure to bring copies of those. She also took some of my pictures.

Good luck on those waiting!

Thanks I'm just waiting for the notice of action letters to be mailed to me. We've already submitted a lot of evidence with our AOS packet, but if anything new happens between now and the interview we will bring copy's and original of those things as well. Thank you for this information! :-)

Re: DACA to AOS

Hey guys

My work permit expiration date is getting closer, and I'm getting more impatient and anxious by the day.
Is there a way I can send USCIS a letter from my employer so that my EAD app from the AOS app is expediated? Would that even help? I have already done my bio for that app.

I feel really bad for all the people here who have lost their jobs, and it feels like I am sort of heading the same way (it's my first legit job, and I'd hate to lose it and have an employment gap)

Any help would be appreciated.

Thanks

Re: DACA to AOS

It took me a little more than three months from filing to getting my EAD through AOS (filed 4/15/16, EAD received 7/18/16). If it holds the same for you then you might not get it in time, but you'd only be out like a week or two. There's really no way to expedite the EAD request so try and talk with HR about possibly going on leave for a couple of weeks (it really shouldn't be more than that). good luck!

My thing is I have already asked HR if I can be on unpaid leave, and they said that's not an option. I would have to be terminated, then rehired. We'll see how it goes I guess.

Thanks

They interviewed my US Citizen spouse first then I was asked to join the interview. The interviewer asked me our full names, husband's date of birth, if he has any siblings, asked me if I had ever met his family, when last I entered the US (never traveled out since I was brought here as a child). I was also asked details about our apartment, asked how I met my husband, asked whether my husband has ever met my parents and siblings, I was asked their names, I was asked if we had ever taken any trips together. The interviewer asked us to leave some pictures from our photo album and also provide any documents that shows comingling. We had bills with our names on them as well as insurance documents. We were thankfully approved on the spot.

Self filed and never received any RFEs.

Thanks for the info, My US citizen spouse also petitioned for me but I also self filed all the paperwork and sent it off to USCIS. I'm just nervous because Its always nerve racking when you deal with immigration. :-/ I hope I get approved and hope for no RFE. I have no criminal history and no run ins with immigration. Did you use 245(I) aka (I-485 supplement A form) to adjust your status? I'm using 245(I) based as a grandfathered deriviate beneficiary to forgive me for unlawful stay for the past 20 years. Had to pay an extra $1,000 penalty fee to use 245(I)

Re: DACA to AOS

The i485a is something else entirely. It is for when you had a petition submitted for you prior to April of like, 2001 or so. Just the i485 is fine for people in our situation IF you entered with inspection. If you entered without, then usually people will get Advance Parole to get that inspection part fulfilled.

My situation was that I entered with a tourist visa but my family was already in process of getting employment sponsorship (H1b) and so my status changed to holding an H4 visa where they gave me a different I94 from the time of entry. My husband and I self-filed and sent in i485, i130, and i765 (extra EAD in case the adjustment takes longer than expected), medical forms and the biographic info sheets required for the i485. We included copies of birth certs, marriage cert, last three tax returns (form 1040 only no worksheets), payment stubs, joint assets docs, retirement docs that show the other as beneficiaries, bills, and aprtment leases for our time living together.

March 28ish - sent application
May 5thish - biometrics
May 15ish - RFE because I forgot to include the number of people we have in household. The form didn't let me type it in and I forgot to write it in; this caused them to think we were under the poverty line because math can't divide by 0. I had to resend our whole tax return, worksheets and all 108 pages because I invest a lot/basis. Also sent more monthly asset statements (basically March +April to give them the latest).
May 22ish - they received RFE docs.
June 15ish - EAD received
June 25 - notice for interview on July 25th
July 25 - interview and petition/adjustment approved
August 1 - physically recieved green card

The interview was straightforward. We went in at the same time, swore an oath to tell nothing but the truth, then the officer asked for the originals of the certs. She also asked a bunch of questions on if I've ever been arrested, was a terrorist or part of a group - criminal stuff. Then she started asking questions. Most of the initial questions were directed to my husband and she asked where/how we met, who cooks, how many were in our wedding, where it was. Ours seemed more conversational that led to talk of parents, their professions, and siblings. Like when my husband was telling her of our wedding story, he mentioned that his brother was the officiant and that led to the sibling partblahblah. Nothing to worry about just tell it like it is. Towards the end she asked about new proof of living/being together where we gave her the new bills, new car docs, new lease - all copies. After that, she picked out a couple of pictures to keep in our huge file (mostly tax returns), then told us there is no decision yet. She gave us a piece of paper basically saying they will review one last time and give us an answer "shortly". Was pretty disappointed when we walked out but then looked it up and apparently it's just standard procedure - still a chance to get approved same day. So ofcourse I checked the case status later that night and it said our case was approved and that the GC was in production.

Pew that was longer than I thought, but hope it helps! I was preeetty darn nervous right before too cause I had no idea what to expect. 'Course, you might get an officer who chooses to do things differently. My friend had one who just fired question after question and took her EAD at the end because he approved them on the spot.

No not at all, I didn't file anything additional. Overstay is forgiven for Immediate Relatives (spouses, children under 21 and parents) of US Citizens. Good luck!! I completely understand your nerves, don't worry too much everything will work out and be fine.

I filed all the following forms (self filed/no lawyer)
(1) 245(I) AKA I-485 supplement A is $1,000
(1) I-485 is $1,070
(1) I-130 is $420
(1) I-864 is $0
(1) I-765 is $0
(1) I-131 is $0
(1) I-693 varys with every civil surgeon for immigration medical exam it cost me $500 and also depends on if you need any new vaccinces that could add up even more make sure to take your vaccination record with you to your appointment with the DR.
(3) I-G32A is $0
(2) G-1145 is $0

So my total for immigration fee's were $2,490
Not including the medical exam because you pay the doctor not immigration for that fee and any other little thing like passport pictures cost and ect ect.

I sent my application July 27th and I got the texts that they received my applications on Aug 2nd also with a MSC case (is that good ?)

I got MSC too, it means it's being processed at the "National Benefit Center" but then later during the process when its ready for interview then it's routed to your nearest USCIS field office thats where they make the final decision on your case. Well the immigration officer does at the end of interview. Are you using 245(I)?
