I think this question might have been asked already, but please answer if anyone knows. On the i765 application for employment authorization, when adjusting do we check new application for EAD since we are getting it under a different category than DACA, or do you check renewal. TIA

I put renewed. The question asks about Employment Authorization not category...you are basically requesting it under a different category.

your comment made me wonder, what are 'originals' of pictures nowadays? almost all of ours are from social media/facebook/instagram/smartphones. Even with financial documents, i sign up for paperless so all of our statements are just my own prints of the online statements/pdfs

Wouldn't it be new application since its the first time you're requesting employment authorization based on that specific category (c9).Then if your interview doesnt happen in a year, then you renew on that category. i but new

Now I'm confused. I know it's being requested under a new category, so does that technically make it a new application for EAD. Or is it still a renewal under a different category. Now I'm not sure, but I might just go with renewal since that's what you put. Idk.

The form also says if it's a renewal to include a copy of your old EAD, did you do that also?

So are you saying you did include pictures in your original AOS or i130 package, before you went on any interview? Clarify, please.

That is incorrect Ianus. The category does matter and under the (c)(9) category unless the filer has a previously expired or expiring one it is a new application.

Please put down new on the form. It is not a renewal.

My application was marked as renewal and we included copies of the DACA based EAD's.

USCIS said nothing on the matter.

I did put new on the form, but was about to redo it based on what was said. @Dream becomes a reality I know you have long passed this part of the process, but where you a self-filer or did you use a lawyer.
Even though I checked new, I still put a copy of my old EAD card and approval letter. Idk, these forms need to be more clear.

No need to include your old EAD card unless you are including it under other evidence as a form of government ID. The trick to filing these forms is to provide only what the instructions ask of you to provide nothing extra. I was a self filer for DACA and for my Adjustment of Status. Was never asked for anything additional.

That doesnt mean that it was the correct way to fill things out it all depends on who reviews your packet. With USCIS one has to err on the side of caution and follow the instructions carefully so as not to provide anything extra that may lead to more questions or delays.
