Re: DACA to AOS

Anyone anticipate any changes or worried about their AOS application post election? I filed back in August and already received my work permit. I'm expecting an interview date in February at this point. I'm just a bit worried about the new administration and if they're going to slow things down or implement new rules.

Especially this
Will it be suspicious to file the petition for alien relative right soon after we get our marriage certificate from City Hall?

We have almost the exact same life, except I am 28 now and been dating my GF for only a year and we've been living together for 6 months.

Just from what I've read, you should be fine with opening a shared bank account only. Maybe move in together and be in the same lease? If not just explain you are in the process to find a place or something. This is something you should discuss with a lawyer.

Also, you for sure will need an sponsor. It doesn't matter how much you make. The sponsor has to be a USC or PR.

Cheers man!

It's good to know that there are people just like me out there and we are not alone.

Cheers!

After spending hours going through forums and online info, I think that is what I will do. I have been going through the forms and what they require.

We should have plenty of proof by the time the interview comes.

Hey Guys,

Trump is about to screw all of us so I am in the process of starting my AOS by marrying my USC girlfriend of 4 years and have several questions.

Here is my situation:
  • Legally entered the US with a tourist visa at age 14.
  • Overstayed since and have not left the country.
  • Received DACA in 2012 and renewed it in 2014
  • EAD is to expire in December 2017 since my EAD is 3 years. I am assuming the worst that my EAD will be invalid when Trump gets into office.

My problem with the AOS application is that:
  • Will it be suspicious to file the AOS right after we get our marriage certificate from City Hall?
  • As of now, we don't share any bills, bank accounts, addresses, etc. Will it be suspicious to have all of that changed a month before we file the AOS?
  • We have traveled a lot around the US and have a good amount of pictures together.
  • My girlfriend is still in school and has no income but I have been making above the poverty line since I got my EAD and my assets are over 100k. Should I still get a sponsor?
  • What am I supposed to put in the I-864 for her income? $0? Also she has been filing her taxes as a dependent under her parents.

I am planning to see an immigration attorney once we have everything together and have more specific questions.

At this point with Trump elected, I am mentally prepared that I might lose my job and remain unemployed for the next months.

What do you guys suggest?

Thanks in advance

Bump.

Currently:
DACA
Married to US Citizen
Returned from my travel with Advance Prole.

First of all I want to say that this community is freaking awesome, you guys are super helpful. This Topic/Thread is really helpful as well, but it requres to dig through hundreds of posts.

All I need to know is there a Check List for me to follow so I can successfully move From DACA to AOS and finally become a US Resident.

So far I have:
I-485
I-130

As long as the marriage is real you don't have to worry about anything.

We have almost the same situation expect that I have been married with USC wife for 7 years and our I-130 is waiting for approval.
