I was in jail for 5 months. :/
 
Well, I got in a really bad car accident. Felony charge. I spent 5 months in jail trying to fight my case to lower it to a misdemeanor. I sat in jail, for no reason, because I had a Border Patrol hold, so no bond, even though I totally qualified for one!!I sat there until the lawyer had everything he needed so I could get the best deal. Finally, Dec. 6, I got two misdemeanors, one year probation and a letter to the victim. The next day I got transferred to the immigration facility in Orlando. Spent two weeks there. I had a bond, again, too high now, so new immigration lawyer lower it. Took two weeks to get a court date. Then I finally did and they had to approve of my bond, two more days. I'm lucky. I got out on Dec. 21. Right before my birthday. I still feel trapped though. My case is not done. I have court on Feb. I'm 21 years old, married, and fighting for a better life. It's really hard. I wish the best of luck to everyone. If you do drive, or are doing anything illegal, be very careful!! Jail is not pretty. Wish me luck. :/

Sorry to hear. I was bonded out after a day and things went my way in court. Curious as to your felony charge as well. Good luck.

Felony was leaving scene with injury. Lowered to leaving scene with property damage. It was pretty awful, please don't judge. I feel awful of my actions. :(

I don't think so,the 'Morton memo' is geared towards those with no major criminal history.Not to be judgemental,but leaving the scene of an accident could be considered a risk to 'public safety' and I can't see any immigration judge or prosecution not taking that seriously into account.

Yeah, I guess now that I know the circumstances it'd be a hard sell.

That sounds rough and I'm sorry to hear but the sitting in jail for no reason part is kind of confusing. Didn't they keep you in there because you left the scene of an accident? I know a guy who spent only a couple nights in jail despite being undocumented. It was a much lesser charge but still, no 'hold' or anything like that.

I know spending time in jail is horrible and I do not wish it to anyone of us but driving without a license is very risky.... I hope you were not drunk-driving.

she got two misdemeanors though those are considered minor crimes one step above an infraction..if a judge sees that shes a student and shes been living here her whole life she might get off the hook. Hell, one of my friends uncles got his green card while he was in jail on a domestic battery charge.

not drunk when I was driving. and I have no felony charge, so I believe my chances are good. I screwed up, but I'm trying my best to fix it and stay positive. Just wanted to share this in case any of you get in trouble, it's not the end of the world. It's really damn hard and I regret it so much, but I'm happy now. Just waiting on my court date now.
Lawyer said I have good chances. I've been living here for 11 years. This is home. I'm a unique case as everyone here. I came illegally, but not my fault. I'm married to a US citizen, so everything will be ok. I'm out of jail, so I'm concentrating on the positives. I have always done charity work, volunteer and have good grades. Never smoke or drink. I just had an accident and didn't know how to react. In jail, I would see way worst people and they are out. I'm a good person. I'm sure my judge will see that. We already filled for me, I'm just waiting to see if I go to Mexico for a while or stay here and get my green card. I believe I won't get deported. And if I do, I'll be coming back with my sweetheart and getting in college like how it supposed to be. Following my Environmental Engineer career. So excited! Can't wait until all this is over.
Good luck to you all! I keep asking for the Dream Act! We are so close! I couldn't wait, had to marry my sweety sooner than we wanted, but I don't regret if. He means everything to me. I'm really happy for us, just hope the judge won't separate us. I'm sure he won't though. I'll keep you guys updated.
