Does Anyone Know How Long It Takes!
 
I just filed to get legalized through marriage. I already know im not leaving the states due to be trying to file before 2002 or something like that. my lawyer informed me. anyways, my lawyer sent everything about a week ago. my question is, does anyone know about how long it will take for me to be able to get the work permit. some ppl i know that went through the same say they got theirs about a month after. some say 2 months.. some say weeks. im just curious!

Congrats on the wedding. I think 2months for the working permit and 6months for the GC.

If he's ewi its the 245i, but you don't need it if you entered with inspection.

i honestly dont know but my dad filed before 2002 with his job. labor department approved him. except the guy who was sponsoring didnt give immigration a year of taxes. anyways we were that close. so because of this i qualified to not leave the country. my lawyer sent all the documents for my marriage petition about a week ago. with fine paid, pictures, documents and all. so im jus wondering how long. i guess its just up in the air it could be months or weeks huh...

3 months for working permit, and 6 months for green card...from what I've heard.

You just got married and she already wants a divorce?

I don't know the circumstances behind her decision, but is her mind completely made up? Could there still be a chance for reconciliation?

Just know that everything happens for a reason. It may be difficult to see that now, but take it one day at a time. And see how things pan out.

For a person to be derivatively 245i eligible the principal applicant,in this case your father,must have had an application for labor cert or application towards residency before April 30th,2001.'Before 2002' doesn't count for 245i eligibility.You might require an I-601 if you entered without inspection and afaik do not meet 245i eligibility.

Application for work permit being approved is usually ~3 months.Usually USCIS also gives a receipt for filed applicants in less than 2 weeks after you've filed.The process usually takes 6-8 months total or less now from filing to interview.

You can still apply if your marriage was real. meaning not for the papers.
Talk to her, she might understand and decide to stay for a while or compromise to something . Offer something on return dont just expect her to do it for nothing.

That depends on why she wants to end it, lol. If he was doing dirty things with the wrong girls,she is probally gonna give immigration his name and address and send them after him.

Since we're on the topic, does anyone know who is supposed to go into the interview with the immigration agent? I know the person who is filing for adjustment of status is, obviously, but I'm wondering if the spouse is required to be there also. Can your lawyer go in with you?

You both will be interview husband and wife you dont need an attorney because they CANNOT answer for you they will pretty much just sit there while you are being question and sometimes attorneys will charge you to go because you are taking their time.

Dont worry about the questions while sometimes they are simple questions other times itll be REALLY personal questions there is no way of knowing exactly, they are looking to match information and reactions to the questions from both the husband and wife.

They are known to ask if you had sex on your honeymoon, questions like that. So be ready

Hmm, we can handle tough questions I'm pretty sure. We're not shy haha. Do you guys know if past immigration history matters? Do they even ask anything about it? Never been deported or anything but you know some agents get all pissy about the littlest crap..

Depends of what kind of "history" youre talking about .. they really care more about proving your marriage is legit more than anything, be ready to answer questions about her family and she will answer about your family , also they will ask you about your family and their status alot of the agents here in San antonio office ask that DO NOT LIE nothing happens to your family they will not go after them or anything they are just getting you to see if you lie or not.

USCIS is considering changes that would allow certain immediate relatives (the spouse, children or parents of a U.S. citizen) who can demonstrate extreme hardship to a U.S. citizen spouse or parent to receive a provisional waiver of the unlawful presence bars before leaving the United States.

These procedures are not in effect and will not be available to potential applicants until USCIS publishes a final rule in the Federal Register specifying the effective date. USCIS plans to publish a notice of proposed rulemaking in the coming months and will consider all comments received as part of that process before publishing a final rule.

Do not send an application requesting a provisional waiver at this time. USCIS will reject any application requesting this new process and we will return the application package and any related fees to the applicant. USCIS cannot accept applications until a final rule is issued and the process change becomes effective.
Be aware that some unauthorized practitioners of immigration law may wrongly claim they can currently file a provisional waiver application (Form I-601) for you. These same individuals may ask you to pay them to file such forms although the process is not yet in place. Please avoid such scams. If you already have an immigrant visa interview with the U.S. Department of State, we strongly encourage you to attend. The Department of State may cancel your immigrant visa registration if you fail to appear at this interview.
