Help! Biometrics Appoiment.
 
hello to all,

i just received by mail my biometrics appointment for the deferred action which is in one week and a half and I'm excited. This is the reason why I'm making this thread.
I came to the U.S. in 1999 thru Ciudad Juarez/El Paso illegally crossing the border and the first time i got caught by border patrol and they took us to the station to take our information, mugshot and scanned our finger prints at that time I was 12 years old but the problem right now is that the day I got caught back in 1999 I changed my legal name to another because of my dad's background in the US. Since I didn't have any documents that day to prove my name the took the info i gave them and they only scanned my index finger to the laser machine they had back then. D
Now my questions to y'all are. D
1) Do y'all think when i do my biometrics the info will show up in their system as the other name?
2) what should i do?
3) can i get in trouble?

p.s. i do have an attorney that is representing me but i haven't told her.

that wouldve been the first thing i mentioned to her ...i would deff go to her office or give her a call and explain the situation

1) Yes theres going to be a mismatch on the names...
2) Go back to your lawyer and tell her about it, see if it would affect you in any way. For sure though its going to delay your app
3) Maybe ...maybe not ask your lawyer

Right now your best bet is your lawyer!!!

no, i only changed my name bach in 1999 when i was caught since then i have use my real name for eveything, credit cards, bank accounts etc.

So, what your saying is that you basically gave the officers a fake name when you got caught and fingerprinted? When you got here you used your real name.

ok, i already spoke to her about this, she said that why i didn't told her since the beginning and this and that. She told me go head and go to the appoinment and if the officer at the biometrics ask me if i have use another name or i have changed my name just to tell him yes i have done it and just tell the truth and if I get detained by ICE she is going to represent me.

any suggestions?

I don't think we have the expertise. I mean you will go in fill a paper. On the section that says other names used. Put the name down. If you remember what it was. Then they will fingerprint you (all your fingers) and take your picture and signature.

Well, in that case just wait and see what happens. I'm assuming you were a minor at that time. This is why you should have told your attorney from the start because you could have checked the box that said you may have potentially been in proceedings, and attached an affidavit explaining the situation.

But, all you can do now is go in for the fingerprints and wait and see. Because the people at the Service Centers don't do anything else besides fingerprinting and taking your picture. I'm not sure that anybody can really edit an application once is send. That would be something that your attorney would have known how to do if it was possible I'm guessing.

what do they check with the finger prints?

It is a background check. It is done by the FBI and as I understand the USCIS system call IBIS. It is basically a database with multiple things.

im searching on what shows on the FBI Background checks and some people said just criminal history, felonies, school records, credit history, irs stuff but they don't mention about entering the country?

This is to give you an idea of what they do. The do not check IRS stuff at all or credit history. They are mostly concerned with criminal stuff.

Keep in mind this is 2006 stuff that was reviewing the system.

You should of told your attorney everything from the start, they are there to help you and not judge you. You have to come clean of all things involved with USCIS/ICE.

I did not know how detailed the background checks were, thank you for the links.

so its mostly criminal stuff right? so i have a chance that what happened to me will not show?

I don't really think you should worry about it too much. If it shows it shows. As long as you fit the other DACA requirements you are good. If it shows and it triggered some sort of deportation DACA basically suspends it for two years. While your in the process of applying for DACA you can't be deported either because you are in process. Unless you do something really bad.


What you can try to do but not sure how you would be able to since you gave CBP a false name is try to get a copy of the record. More for your own records but consult this with your lawyer.
