CIR passes yay, if it doesn't, what are your next plans?

Me personally, I really don't care if it passes or not. If it passes, then awesome, and if it doesn't then I am not going let it get to me. I have stated that here many times, so I am not too excited for a CIR. I will find my own ways of fixing my status through other means, and if I can't change my status, move to a different country and find employment there, but seriously not going to let that stress me out.

So what are your guys plans if a cir was not to pass this year or the next or the next hypothetically speaking? Move back home, find your own ways of changing your status, continue living as so?

My step father has an EB-2, 245(i) grandfathered labor petition going (currently still on the step of the getting the PERM). If the I-140 is filed before I turn 21 in December, and I can get my deportation order removed, I'll be a permanent resident.

If I somehow manage to age out (and I'm covered by CSPA as long as the I-140 is filed before I hit 21, and I file I-485 to adjust status within a year of the former's approval), then I really don't have much of a plan B, as deportation order + EWI makes me illegible to adjust status via any way that doesn't pardon EWI (and only 245(i) does that, and I'm not a grandfathered beneficiary).

I have to say the optimism in the forum had actually got to me, I was a skeptic at the beginning, now I'm lurking the forum several times a day for auspicious sign. But besides all the talks, there is nothing materialized yet, noting tangible that we can touch.

If it doesn't get pass, well, I do guess I have to move. I'm not sure just when I should stop hoping though.

What happened that you got an order of deportation against you?

Keep on fighting! But yea, that would definitely be heartbreaking. As for me I guess wait for a 25 year petition from my parents. I'm from the Philippines, so it's going to take awhile.

Nothing criminal. My mother and I were caught trying to EWI on the Mexican Border, released on supervision. We were never heard from again. Never received any court papers, ordered removed in absentia.

Generally you only have 180 days to re-open an immigration case after an order in absentia, unless you can demonstrate that either postal service fucked up, or there was some other exceptional circumstances. In my case the lawyer will likely argue that I was 11 at the time, so I didn't know, and even if I did I wouldn't go on my own from NY to AZ to attend the court hearing. We still don't know what to do with my mother.

I didn't even know I had a deportation order until DACA came about, and one of the questions was "Were you ever in removal proceedings?".

Like many other people, I'll have a huge weight lifted from my shoulders.

Nine years ago, my USC grandfather filed an I-130 for my mother. I was under 18 at the time, but our lawyer told me that I'd age out this year. The I-130 was approved, but we're waiting on visa numbers to become available. And based on our category, that may take another three years (but you know I really mean ten ).

I'm hoping they deal with visa number availability and she can adjust her status within the country. If not, she can just head the route of whatever program is created under CIR.

Once her immigration situation is settled and we see what kind of status DREAMers obtain, I can go to medical school.

Hmm interesting scenario there. But as for me, I believe the CIR will have to be negotiated one way or another until we see a reasonable end to help immigrants in need, who are essential part of our economy.

Yeah for until the remainder of DACA we can't do much but wait and see

Wow I'm almost in the exact same position as you, except 11-12 years. So if we age out, we're not eligible? O: My mother was approved for married daughter over the age of 21. It was under my impression that once our priority date came along, which will be another 8 years, her spouse and children are derivative beneficiaries, but I didn't know this would be void if we aged out. Huh. Oh well, at least it helps that we're "in line", no?

If you age-out (as I have done), your mother can then petition for you as a unmarried adult daughter. Unfortunately you lose your place in line and have to wait all over again. There is a lawsuit about CSPA or aging-out going on to help us out by letting us retain our priority date. As of currently the case is heading to the Supreme court. For more information check out this website.

I am thinking movie to Germany after moving back home and seek employment there. USA degrees with experiences are always worth something.

If it doesn't pass it this year or at all then my only hope is that DOMA fell apart, that way, I can be citizen by marriage. I hope they get rid of DOMA if not then my U.S. citizen, sister, can petition for me.

Passage of the Dream Act looks promising this year. Even if they don't pass CIR, the republicans might agree to pass the Dream Act as a consolation prize to save face with the hispanic electorate.

I have another 5 yrs left in my grad program. Grad school will buy you a lot of time :)

I'd like to say that I didn't care if it passes or not, but I do. As far as what I would do? I guess the same I've been doing so far, trying to finish school and making the best out of life.

Re: CIR passes yay, if it doesn't, what are your next plans?

Why leave the country when you can renew your DACA? Also if CIR doesn't pass the DREAM ACT has much broader support and will certainly pass. I don't understand your logic. The only thing I can think of is that you will age out to benefit from the current DA.

Pianoswithoutfaith 02-17-2013 04:17 PM

Re: CIR passes yay, if it doesn't, what are your next plans?

The logic is very simple, doesn't take hard to get the idea, no dream act, no cir, DACA is no longer in place, what would be your options?

Because if you are seriously relying on a CIR/DREAM Act/DACA to paved your future, you should start looking at your next options.

You ever heard of hypothetical scenarios before?

I will continue the struggle. If possible, i will find me a U.S. citizen girlfriend and merry her, but not for the papers.

What if you Denied For DACA, then can you reapply for Dream Act???? If that passes this year.

Re: CIR passes yay, if it doesn't, what are your next plans?

We don't know. If you want me to speculate, I imagine you would not be eligible for a Dream Act since the requirements for the previous ones are similar to the DACA onces. BUT DACA was a bit strict because it wanted evidence of your presence on a very specific date, I hope A Dream Act does not but now we have an slight idea how it would work out so I recommend everyone to KEEP and SAVE every record, EVERY DAY try to get a record of you being here.

Well for me..its as follows. I'm all set with DACA. Definitely set for 6 years. The main question is for my parents, what will they do if CIR doesn't pass this year? Honestly, not too sure and also we're not worried at all. I think they might've gotten us into very good positions so they could actually leave for good. Who knows? Tough to speculate right now but I think CIR will pass this summer. I'm throwing a big freakin party at my home when this happens.

For years my friends and lawyers have told me to marry some fat, uneducated chick with a mustache and 3 kids (Ok, I may have combined all their recommendations into one) and stop going after the alpha types who have several graduate degrees and are looking for established guys or crazy artsy girls, but I'm still holding off for a real marriage. At this point, I am going down with the ship. If they can speed up legal immigration, I still have a USC sibiling petition that was done in 2005 for me...one of these decades that will kick in. Then again, who knows. People get run over by buses every day too so you can't really plan for everything.

If it doesn't pass? Move on. I am fortunate enough to have DACA, so that helps. I would eventually adjust some other way. I don't plan on leaving anytime soon.
