Individuals in unlawful status may apply to adjust their status to the legal status of RegisteredProvisional Immigrant Status.

Eligibility Criteria:

Residence in the United States prior to December 31, 2011 and maintenance of continuous physical presence since then.

Paid a $500 penalty fee (except for DREAM Act eligible students), and assessed taxes, per adult applicant in addition to all applicable fees required to pay for the cost of processing the application.

Ineligible if:
o
Convicted of an aggravated felony;
o
Convicted of a felony;
o
Convicted of 3 or more misdemeanors;
o
Convicted of an offense under foreign law;
o
Unlawfully Voted; and
o
Inadmissible for Criminal, National Security, Public Health, or other moralitygrounds.

Spouses and children of people in RPI status can be petitioned for as derivatives of the principal applicant (but must be in the United States at the time).

Immigrants in RPI status can work for any employer and travel outside of the United States

Individuals outside of the United States who were previously here before December 31, 2011and were deported for non-criminal reasons can apply to re-enter the United States in RPIstatus if they are the spouse, of or parent of a child who is, United States citizen or lawful permanent resident; or are a childhood arrival who is eligible for the DREAM Act.

The Application period will be for 1 year with the possibility of extension by the Secretaryfor an additional 1 year.

Individuals with removal orders will be permitted to apply as will aliens currently in removal proceedings.

RPI status shall last for a 6-year term that is renewable if the immigrant does not commit anyacts that would render the alien deportable. Another $500 penalty fee is applicable at thistime.

The Secretary may collect a processing fee from individuals who register for RPI status in anamount that is sufficient to recover all of the costs of implementing the registration program.

An individual who has been granted RPI status is not eligible for any Federal means-tested public benefit (as such term is defined in section 403 of the Personal Responsibility andWork Opportunity Reconciliation Act of 1996 (8 U.S.C. 1613)).

An individual who adjusts from registered provisional immigrant status to lawful permanentresidence shall be deemed, as of the date of such adjustment, to have completed the five-year period specified in 8 USC 1612 and 1613.

A noncitizen granted registered provisional immigrant status under this section shall beconsidered lawfully present in the United States for all purposes, while such noncitizenremains in such status, except that the noncitizen
o
is not entitled to the premium assistance tax credit authorized under section 36Bof the Internal Revenue Code of 1986; and
o
shall be subject to the rules applicable to individuals not lawfully present that areset forth in section 1402(e) of the Patient Protection and Affordable Care Act (42U.S.C. 18071).

After 10 years, aliens in RPI status may adjust to Lawful Permanent Resident Status throughthe same Merit Based System everyone else must use to earn a green card (described below)if the following things have occurred:
o
The alien maintained continuous physical presence
o
They paid all taxes owed during the period that they are in status as an RPI
o
They worked in the United States regularly;
o
And demonstrated knowledge of Civics and English
o
All people currently waiting for family and employment green cards as of the date of enactment have had their priority date become current.
o
A $1,000 penalty fee is rendered

People in DREAM Act Status and the Agricultural Program can get their green cards in 5years and DREAM Act kids will be eligible for citizenship immediately after they get their green cards.

It's not saying anything about dreamers just that were getting a GC in 5 years & later we can become citizens....that's it!? Really no more details ?

lol Chill brah. This bill is Comprehensive. I'm sure you will be fine. Just wait for the text to come out. There's millions upon millions of people in your shoes. Don't worry. There's a reason why I bold that word. This is not DACA. This is a definite solution.

What i dont get is.. ok get a green card after 5 years and then you can just immediately apply for citizenship? something just seems off about that , so apply for a green card then when it arrives apply for citizenship that makes absolutely no sense .. just saying .. still doesn't say anything about if you already have an approved i 130 and waiting on a visa , does anyone know how that is gonna work out?

Sorry I'm just nervous :( it's because I claimed us citizenship on an I-9 form back in November 2011 and I quit that same month and same year novemeber 2011 I was only there for 3-4 weeks. I'm just scared.....

I don't see how the Congress can dictate that one individual group[Dreamers] legalizing under Registered Provisional Immigrant status can fulfill the residency requirements for Naturalization while another group[General undocumented population] cannot under the very same status.I think that would violate the equal protection clause of the US Constitution.Dreamers will likely be given a separate status and it seems rather likely to be a Conditional GC that could also fulfill the requirements of not only Naturalization but the ability to enter the Armed services.

i wonder which DREAM Act they are talking about when they source those that are "eligible for the Dream Act". I hope it's not the one the DACA because that'd leave a bunch of Dreamers out AGAIN!

Under one component of this merit based system the Secretary will allocate merit-based immigrant visas beginning on October 1, 2014 for employment-based visas that have been pending for three years, family-based petitions that were filed prior to enactment and have been pending for five years, long-term alien workers and other merit based immigrant workers.


ok so those who have an approved i 130 my parents have been waiting 10 years their priority date is in 2003 , will be able to adjust from october 1st 2014 ? according to this information ?

Wow reading initially through the legalization part, it certainly seems like we are being given a pretty good bill here. The only thing that could change this are amendments on the Senate floor. Things looking very bright here. I stopped reading when I saw under RPI status we will be able to travel and work for any employer. That's all we've been asking for. Looks like if things hold up we should become citizens in five years!

What I don't get is that we will have To wait until 2018 to get RPI or as soon as it passes ....bc I want to enlist asap & this would have to make me wait 5 more yrs ...I wanna see how that other bill is going to be like

It could longer. Look at the health reform its been years and most of its key elements don't take action until this year and the years to do for follow


Just because it passes and is enacted doesn't mean right away

No that is absolutely ridiculous. We wouldn't have to wait for 5 years. I'm pretty sure the time frame will be very similar to DACA. This is an urgent issue. The rest of the parts of the bill will take time to implement but I think the initial RPI status won't take too long. I would say about 5 months for set up and another 5 months for approval. The entire process towards citizenship will be faster for Dreamers. Lets not get confused with the language.

That's what we don't know yet. One theory is first we get a conditional GC, after 5 years full GC and immediately able to apply for citizenship

it seems they are using terms like instantly and immediately but I think they are using these terms just to compare how much faster the process will be for us. If you think about it, the other path is 10 years, plus w/e number of years it takes to say the border is secured, then 3 or 5 years after that for citizenship, so it could take as much as 20 years and is what experts are saying it will take for citizenship. While for dreamers, the process should take less than 5, CPR, GR, then 3 years, citizenship, we don't need border secure approval for our status to change. We will see how it is when it comes out today

To clarify:

Dreamers will be give a CONDITIONAL GREEN CARD, so we don't chain legalize our families right away. The conditional provisions will be lifted after 5 years, however since the conditional green card also applies towards the 5-years wait time for citizenship, we will be able to apply for them together.

Note that this is speculation but it seems like the most reasonable interpretation.

yes, under our current immigration laws, however, don't forget this comprensive immigration reform is just not about fixing the status of people here with out authorization but reforming our immigration, they could well change this.

We will have to wait until 3 today to find out of all our speculations were correct

That would be a good idea. We have have already sent in documentation proving our presence going back to five years and done biometrics. I dont mind repaying the application fee.

where do you guys see CONDITIONAL GREEN CARD? It says clearly we will get green cards in 5 years. From my assessment, it seems like we will be RPI just like our parents. RPI seems like a CGC anyways. We can travel and work.

Because the more stuff is coming out, the more it starting to look exactly like the previous Dream Acts?

I wouldn't be surprise if they outline just copy and pasted the Dream Act into this changing it a little bit


We are not certain for sure obviously, its all talk and speculation

we wont know until later today
