New DACA executive action, is DACA being exapnded???
https://www.whitehouse.gov/briefing-...lies-together/
I wonder what and other Dreamers mean, is DACA being expanded???? Easing the Visa Process for U.S. College Graduates, Including Dreamers Today’s announcement will allow individuals, including DACA recipients and other Dreamers, who have earned a degree at an accredited U.S. institution of higher education in the United States, and who have received an offer of employment from a U.S. employer in a field related to their degree, to more quickly receive work visas. Recognizing that it is in our national interest to ensure that individuals who are educated in the U.S. are able to use their skills and education to benefit our country, the Administration is taking action to facilitate the employment visa process for those who have graduated from college and have a high-skilled job offer, including DACA recipients and other Dreamers. |

"H-1B visa holders can become eligible to apply for a US Green Card, or permanent resident card, after six years in the US. This is because the H-1B visa is considered "dual intent", which means it offers a path to permanent residence. The process of getting a Green Card from an H-1B visa is also known as the H-1B to Green Card transfer or the Employment Based Green Card. " |
Re: New DACA executive action, is DACA being exapnded???
Will the employer bear the cost of the application or will they be shifted to the beneficiary? Some employers are not willing to sponsor so what happens in those cases?

Re: New DACA executive action, is DACA being exapnded???
Can this be used to remove the 10yr ban, so that one can leave and just come back to visit?
|
Re: New DACA executive action, is DACA being exapnded???
Is this employer sponsorship or automatic eligibility for a work visa?
How does this help Dreamers left out of DACA regardless of age? What happens if you ALREADY have a job (independent of degree) since DACA only requires a HS diploma? H1B is monopolized by Indian/SE Asian migrants and their dependents. WHAT ABOUT LATIN IMMIGRANTS WHO HAVE BEEN HERE FOR DECADES IN ESSENTIAL OCCUPATIONS? So many questions... |
Re: New DACA executive action, is DACA being exapnded???
what if i wasnt stupid enough to go to college and got a high skill job? tf is this

Re: New DACA executive action, is DACA being exapnded???
The second point of DACA (first one being deportation protection) is that it provides access to higher education - so 99% of Dreamers who were left out of DACA do not have access to secure employment and higher education!
Children of H1Bs have access to income and higher education; it just expires at 21 or after college, so this will help them stay while their petitions become current. For those over 21, the wait can be long as Mexico, Philippines, so this just lets them apply for their own work visa, am I understanding correctly? How is this fair to farmworkers, etc? I think this is racist, not because it is not a good thing, but because it continues to exclude those in most need who have been in this country the longest. |

Has this been passed or still on works?

Re: New DACA executive action, is DACA being exapnded???
Here is more context.
https://www.fwd.us/news/d3-waiver/ This whole daca update is about updating a waiver to allow daca and other people with degrees to apply for a sponsored job visa wihout having to leave the country. like some people said this makes no sense for the current daca population but it might help other people who have degrees and a job offer |

Re: New DACA executive action, is DACA being exapnded???
How does this work? Is this company sponsored? Does this mean we need to tell to our company we need H1b sponsorship? As far as I know the regular working visa holder can only work on 1 company and if they change their jobs, they have to ask the new or prospective employers if they do sponsorship. Are we going to be on the same situation as that? And what if we lose our job, does this mean we lose the status of daca holder?
|
Re: New DACA executive action, is DACA being exapnded???
@demise- can you break this down for us? Would current daca recipients have to now be visa holders?

So its "racist" cause it doesnt benefit you or because you dont like it? This thinking is so dense, man. This literally helps a lot of people. This prolly wont benefit me but I doubt its "racist" |
Re: New DACA executive action, is DACA being exapnded???
this article explains it a little better.
https://www.presidentsalliance.org/w...d-Dreamers.pdf https://www.fwd.us/news/d3-waiver/ If they were sponsored by their employer for a visa, they could secure a legal status and more reliable and secure work authorization. Certain visas, like H-1Bs, could even open pathways to permanent residency and the chance to apply for citizenship. And their employers would have certainty that they would be able to retain and invest in talented, valued members of their team for years to come. They might allow DACA recipients to stay in the US during the H1B process. Meaning, DACA recipients could stay in the US until the approval or disapproval. |

I dont think this action will benefit DACA people with 10 year ban. I hope they will consider removing the 10 year ban for DACA people so people who received DACA after they turned 18.5 years could also take advantage of it.

If you are married to a U.S Citizen then your spouse can petition you anyways. How does this new process help? It can help EWI spouses since they don’t have to leave country.
Also how will DACA holder or an undocumented person apply for this benefit? How can you guy sponsor from an employer as a DACA or an undocumented? Last edited by DA |

Remember that this process “streamlines” the visa for DACA people. We have to wait for the details before judging the process.

Re: New DACA executive action, is DACA being exapnded???
It feels you get more uncertainty with H1B than with DACA. Just my opinion.

I don’t think there will be anymore updates than what we already have. The only thing Biden could possible do to make it “streamline” is anyone with a college degree in a “ high skill” occupation gets automatically grandfathered into a special type of work visa. No need to look for a job willing to sponsor you |

Re: New DACA executive action, is DACA being exapnded???
I’ve never looked deep into H1B visas but if we are talking about the one that already exist. Then anyone applying for this is gonna enter a very competitive market. You got lots of 2Faces Indians and Arabs all applying for the same visas. Biden needs to create a new type of H1B visa maybe call it H1C33 that is only for daca recipients. Otherwise we are dead in the water, the requirements for a H1B are already super strict

If we are following the current process then yes it’s just an H1B visa without us having to leave the country
But something tells me more details will be revealed in the coming days https://www.presidentsalliance.org/w...d-Dreamers.pdf |
Re: New DACA executive action, is DACA being exapnded???
there is no way they make another subset of special work visas for us, bro. that aint happening. lol
