i-130 and dream act
i-130 was filed for me and my sister. Unmarried, under 21. My lawyer told me that the fact the we entered the U.S. without a visa when we were 8 and 6 years old was a problem and therefore we will have to wait for the dream act. When the Dream Act passes will we get our green cards or would we have to be on the 6 year residence (dream act)?

Its two separate things. Your lawyer told you you'd have to wait for Dream Act because he knows your family based petition most likely won't get the job done.
So yes, if you're going to attempt to use DA benefits, you'll have to follow the guidelines.. Wait 6 years for Green card. (you get a temporary Green card during the first 6 years though) |
