They are all just betting SC will end it but I don't even think the SC wants to touch this. As much people like 2Face, Smooth or Liberterian want DACA to burn in courts, it won't anytime soon. This issue might even be drag unto 2024

Why would Hanen care about backlash against him? I can understand Trump, but Hanen has no dog in the fight of not killing it.

I mean - he could have a soft spot for dreamers. He certainly could’ve already nuked the program (no renewals) as with DAPA.

22/ Moreover, I'm not sure how this decision affects the DACA case. I had expected a GVR, based on the census case, in light of the fact that the court probed the Director's intent. Now, such a GVR would not work.

Prediction: tomorrow, the DACA cases will be sent back to the agency for reconsideration in light of the Census case, on the ground that the administration’s rationale for ending DACA arguably doesn’t match the facts of what it did. So DACA will live on, briefly.

But Trump already killed DACA. The program isn’t accepting new applicants. Renewals only.

Per the Scotus Blog:

25/ One other wrinkle in the DACA matter. Judge Hanen was scheduled to hear oral argument in July. That hearing was pushed forward till October. #SCOTUS may go the entirety of Trump's first term in office w/out hearing DACA challenge.

i believe

G-- take the case
V-- abandon the case (not hear it)
R-- return the case to a lower court.

I may be wrong
