Lost I-94 visa and passport
 

Hi guys! I have a question regarding a lost passport, visa and I-94 from over 20 years ago. My USC brother will be petitioning my mom and she’s a visa overstay but lost all of her documents long ago. She doesn’t have any copies. What would be best to file, form I-102 or FOIA from cbp? Her port of entry was San Diego by land and she says she’s sure her visa was checked.

Probably both. I would consult a lawyer first. She will need to prove legal entry. Also, look into Quilantan Entry. Did she have any petition on or before 4/30/01.

Last resort would be to file a waiver.

Did she get a new Passport made?

Do a FOIA with CBP and if that turns up nothing then she'll have to file I-102. Considering that she was admitted and I-94 was actually issued then there's most likely paper trail.

So we submitted an FOIA requests to CBP and they said no records were found. Another request was made with more information that she was able to remember and it also came back with no records found. Do you think anything will show up on the I-102?

She tried going to the consulate to see if they had records of the passport she used along with that visa and they said nothing shows up except the passports she got here even though they use the same system in Mexico. A family member who works in the Mexican embassy in D.C. also tried and she could only see the ones obtained here.

Does anyone know how else to get visa records or anything that can show her visa number?
