deferred action and 245i
 
Hi everyone. I'm currently covered by 245I but due to the wait time, I may she out under many moms application. However, since I'm grandfathered under the clause I can still adjust my status through marriage. If I do end up qualifying for the work permit, could I sulk get married to a citizen and become a resident?

Yeah I'm in the same situation, but was your mom's application submitted yet? I think as long as it was submitted before you turned 21, you should be protected!
But since you are a derivative under your mom's 245i, you should be able to adjust in the future.

245i most likely will be extended, especially if Obama is still the President. Starting this October the cases of people not being covered by 245i will have their priority dates, so we will see what action will be taken.

Also starting October the number of visas/green cards given out through a family petition will increase from 7% to 15%.

The increase of visas was new about 3 months ago or so. As of when people that won't qualify under 245i that will come up on October (Not mexico, india or china), by looking at the priority dates for "All other countries" you can see that people that their priority dates comes up on October they won't qualify for it.

Why do I say it will most likely be extended? Because it is a simple tweak and it is up to the agencies and not the president.... and if Obama wants to keep families together he will do so.

I'm actually in the same situation. Grandfathered under 245i. From what I know, if you were under 21 when the filing happened, then you don't age out.

Now, Djdieg007, can you elaborate more on whatever's happening in October?

Where is the increase of Visas information?

Eh...I'd like to think so, but 245(i) is part of the statute, which only Congress can change...

H.R. 3012 increases, from 7 to 15% of the total number of available visa for family petitions. It starts this fiscal year, so in October.
