I was wondering if there are any documented dreamies who were also brought here when they were kids and are now in some sort of legal status (like F1 etc).

I am one of the legal dreamies who was brought here by my parents years ago but due to the slow and broken immigration system, I am barely making it here in some student visa. Then they will ask me to return to my home country where I don't have my friends/family/life or get stuck in the H1B program.

The bad news is that, I am not even sure if the Dream Act will cover us. The two words in the text that are important are "inadmissible" and "reportable" The legal dreamies would neither be deportable or inadmissible. What do you guys think ? Anyone here in a similar situation ?

I am also a "legal-dreamy." But I also suffer with those who don't have the same opportunity as I have--like friends and family, and even my boy-friend. I support the Dream Act, fully, and I hope something positive will happen for us, "immigrants". They call us aliens, they call us illegals, and they call us law-breakers, but what they don't know is that we have hearts, we are humans and most importantly, we are dreamers!...

As for your situation, do you only have a student visa? Or a green-card?
I was able to get FAFSA, which is financial aid, but i am a U.S. Citizen, luckly.
However, I heard that Obama is going to modify the requirements again, do you know if that's true?

LDream0968, thanks for supporting us ! We need citizens like you who support us !

As for my status, I'm currently on F1. I am not eligible for FAFSA. I am 100% sure that Obamaba or any lawmaker wont make any changes to the requirements as this aid is taxpayers money and that will start a big debate. So I doubt the FAFSA or any federal/state aid will open up to non-US Citizens or non-Permanent Residents.

Lets hope this Dream Act will pass and it also includes us legal dreamies as well.

I am not sure if I am legal or Illegal.
Her's my story.

I was brought here when I was 12 and somehow our family was
able to apply for green card and I have I-485(Application for permanent residency).
But the case was denied around 2004 and and we did not take any action.
Am I considered legal or illegal?
Do I qualify for Dream Act if it is enacted?

I have I-94 and now I am 21 years old.

same here.. am i legal or illegal ..
i was brought here when i was 11..and i apply for a green card and now i have to wait for the visa bulletin in order to send my I-485..im just hoping i dont turn 21 before the priority date become current..... so my hope is on the dream act.. :confused:

boosterman, since your stay here is not authorized due to your denial, I think you will be considered as 'Deportable' but I am not sure about this. The main interpretation of this is based on if 'Out of Status' aliens are considered as either 'Deportable' or 'Inadmissible'

C-Zar, if have not turned 21 yet and if you have already filed your I-40, then I believe your 'visa' age is frozen according to the The Child Status Protection Act of 2002 (CSPA). Please lookup more info on this act. I think you don't have anything to worry about anything unless your 485 gets denied. I am no lawyer. I would defnitely contact an Immigration lawyer regarding this issue.

I am technically legal, recently obtained a student visa too. According to my lawyer, I do qualify for the DREAM Act, and I can always make myself deportable if the DREAM Act does pass.

It's a weird situation to be in, but I think we are quite lucky because at least we do not have to fear being deported.

Yeah I was thinking about this too...
If I am on a valid i-94 that is about to expire in a few months, then if the dream act passes all I would have to do is stay past my i-94 date.

Ive been trying to find the wording in the Dream Act that says it only applies for undocumented/deportable immigrants but I can't find it. All I see are the same basic requirements on every website that make no mention of current status in the US

I came to US by myself as an F-1 student when I was 14. My parents came after 2 years on E-2 visa and I was on their visa. We applied for green card but got scammed and I turned 21. I'm still on F-1 visa right now and not sure if dream act would save me also. I hope it does... I guess im one of the 'legal dreamies'
