Would Dream Act only benefit illegal People?
 
I'm asking, because I'm a young 18 year old student, who came to the United States illegally in 1998, but after a Hurricane devastated my country, the US Congress pass a law to us people from Honduras and other small central American countries a TPS (Temporary Protectice Status) and yea Since then I have had

It being 10 years now, almost 11 and my dream is to join the Military, but I can't because I need a Green Card, and I can't apply for a green card.

I have a High School Diploma, no criminal background at all, and my goal is to serve in the military but I can't

the TPS is not design for people like me, who has different plans and wants different directions

So I wondered if the Dream Act, would also benefit people like me?

Are you out of status now?

You qualify if you are attending/already attended college and if you have been here for at least 5 years.

No I still have the TPS, till next June of 2010, and I believe it might get extended for another 1-2 years period (they have extended this since 1999 I believe)..

I currently don't attend college, I can't find a job, and I need my parents support to get some kind of financial aid, which I tried about a month ago, but my parents dont really support me, so I can't right now...

overall my dream really is the military, I do plan to go to college but my real interest is to serve in the military.

I did travel to Honduras for vacations I believe it was in 2003, but only for a month, I came back, all in a legal process.

In October It will be 11 years for me living in this country, which I consider my country since really, like many people in this forum, they have being living in this country all their life.

Really? That means if I don't attend college, I will be disqualified????!!!

If you haven't completed at least two years of college when it passes and you decide to do nothing throughout the six years of conditional residency.. yes that means you're disqualified.

On the other hand, if you've already completed two years of school and let's say the Dream Act passes a little later this year, you're free to do as you'd like during those six years. You could do as much more school as you'd like or none at all. That would be your call.

I am familiarized with the Dream Act honey. He asked if he'd be disqualified would he choose not to go to school. If he hasn't already completed 2 years, yes he qualifies but if he chooses not to go to school during those 6 years then I assume the conditional residency would not move forward to Permanent Residency. Or am I missing something here?

What do I need to do if the DREAM Act should pass?

If the DREAM Act passes, an undocumented individual meeting those qualifying conditions stated above, would have to do the following:

Apply for the DREAM Act (Since the legislation has not yet passed, there are no specific guidelines on how to apply)
Once approved and granted Conditional Permanent Residency, the individual would have to do one of the following:

1. Enroll in an institution of higher education in order to pursue a bachelor's degree or higher degree or

2. Enlist in one of the branches of the United States Military

Within 6 years of approval for conditional permanent residency, the individual must have completed at least two (2) years of one of the options outlined in the previous step
...

Those who have already completed at least 2 years of college education towards a bachelor's degree or higher degree, will still have to wait the 5 ½ years in order to apply for Legal Permanent Residency even though you may have already obtained a degree.

Students who do not complete the requirements will be disqualified ."

EDIT:

Jay Stone: Ah ok, I hadn't seen. In that case, of course you don't need to complete two years of school. The military option would be enough as you can see in the information above.

^^ your missing the part where he said he wishes to go to the Military...in which case he does not have to complete ANY years of school and take up the Military option in the DA.

Ok... just to make it clear:

To qualify for the DREAM Act you need to have come here before turning 16, be present in the U.S. for at least 5 years before DA passes, have good moral character and have high school diploma or GED.

If the DA passes and you meet all those qualifiers, you will have 6 years of conditional permanent residency to finish at least 2 years of college or military duty. If you finish those two years of college/military in the 6 years, you can apply for permanent residency. If you do not finish those requirements within 6 years then you will go back to whatever status you were before.

To the OP, I do think you will qualify for this even if you have TPS, but don't quote me on that, it's just my opinion.
