Family Petition and the Dream Act
I've read somwhere in this website that those who are going through the legalization process through family petition can't benefit from the Dream Act, is that true? My parents just got their permanent residency so I can pursue that option through 245i while being in the US but I am worried that I might be shutting myself out of the Dream Act option. It is especially worrisome because I am above 21 and it will take many years for me to get legalized through family petition.

Well, the DREAM Act hasn't passed yet, and you will learn what its final destination (trash can or the President's desk) is within a few weeks. So, I would not worry about it or think about it. If the DREAM Act passes, then you can consult with a lawyer.

Well, the problem is my parents are badgering me to file for family petition immediately. That's why I'd like to know about it as soon as possible.

Why don't you apply through your parents? Is this based on a F-4 petition? Why didn't you apply with them when they applied? You might have hurt your chances of being approved...
Edit: I see you'd have to wait many years so I'm assuming it wasn't a F-4 petition. Why don't you wait until something happens with DREAM and then apply through your parents? |
