Possible way out for aged-out dreamers - brainstorming
 
For those who won't qualify because you are over 30 - how about this option.

Step 1) Apply under Obama's EO deferred action relief anyway
Step 2 ) Your application will be denied since you are over 30 years of age. When the application gets denied, USCIS will issue an NTA and start the removal proceeding
Step 3) Once the NTA is issued, apply for prosecutorial discretion under the June 17, 2011 DHS memo.. There is nothing in last year's memo says that you wouldn't be qualified for being 31 or 32.

This would be risky for the 30+ year old dreamers. But it's technically feasible.

Just wait for something to be done for the 30+ dreamers. I'm sure they will not forget about you guys.

Step 1 : Step 1 is the far as you will go.

Step 2: It will goes to a garbage can, denied. It could go to removal proceedings.

Step 3: You cannot do that. Read the memo. It is like a 50/50 gamble too.

This is same thing as last year's Morton memo.

It would only make sense to apply IF one already in any removal proceedings regardless of age with a nexperienced lawyer.

Listen fellas..especially DA. Here is my take on this. This is a MAJOR DEVELOPMENT for ALL OF US..not just the under 30. If Romney is to have ANY CHANCE at all, Rubio will have to introduce that bill, I am telling you. There is no way these Dream leaders have forgotten about the older dreamers. I'm sorry you've aged out for now, but there is certainly something coming!

It does no good to original Dreamers though who are 31+ with Degrees.

Vargas is aware and he was happy and I think he is graduating from UCLA today.

Well, I think that since under 30 dreamers don't have to worry about the removal proceedings, we can come out to public and push the DA harder. The relief gives us opportunity to work, which is huge, but it is still temporary, so we can fight for better cause

I understand the disappointment the 30+ dreamers are going through. Believe me, I wish everyone was included. But it is what it is! And regardless of what it is, it's a GREAT development! GOP now has to show something that they care for the latino constituents. Up until now, many 'otherwise would be' Obama voters were on the fence because of his nasty deportation record. Now his latino voting base is pretty much solidified. If I were a GOP strategist, I would call Mitt Romney right away to act NOW.

Have patience. You all have waited for MANY years. Things will get better!

Just a message to the older dreamers who have been TEMPORARILY been left off today. This is just a rule, its not even a law. To DA USER and all Dreamers over 30, let me please share a few quotes from Gaby Pacheco's timeline.

True so we need these Dreamers to push for the Dream Act harder then ever now.

Gaby is under 30 and Vargas is over 30. Vargas is a classy guy as he was very happy today.

I for one will not risk outing myself like that. It's just too risky to say "Here I am! I think I know your rules better than you do so don't deport me!".

We just have to be patient...again and not do anything stupid in the meanwhile. It's hard I know. I barely got any sleep last night because whether I try to put on a brave face and no matter how much coping skills I have (and I have better than average), there is no getting around it that this is just another giant slap to the face.

I was more than happy when my family got their GC's and I am glad they got theirs before me because I can carry the weight for them. But throughout my 26 years here I have watched time and time again people who come here and get "married" to a stripper they paid off and act like hot shots; people who don't speak a word of English or are even happy here win the Visa Lottery get their green cards; trophy wives who only married to escape their country get their green cards, etc. etc. etc. and I have to wonder what the hell would be so wrong if I got mine? Why not me?

Sooooooo it stinks, but we can't do anything stupid like basically turn ourselves in. Nobody is going to touch Vargas because he's high profile. The rest of us are vulnerable.

My hope is that the younger Dreamers don't throw us under the bus and fight for us too. Sadly, I'm not too confident because as is human nature, it's going to be everyone for themselves when it's go time.
