is my daughter qulified for Dream Act
 

Hi All,

My daughter is in college now, she can not apply green card with me because she is over 21 years old, she match all the condition of Dream act except she is on F-1 Visa now. My question is, if she graduate and lose her F-1 Visa, but she wants to stay in USA, since she has no connection in Canada, Can she apply green card by using Dream Act?

I don't think so. It is only for people that came here when they were 15 or younger. She can try to find sponsorship from a company. What is her major? if it's something with science/engineering it would be easier, accounting also.

If she has a F1 visa, please try every methods exist in the system to legalize your daughter. She can be legalize through employment sponsorship, immediate relative sponsorship, marriage and etc...

Remember that Deferred Action is not legal status. Most people here will die for a F1 visa because there is a path way to citizenship with this visa.

Well. If she satisfies every condition other than being legal, she could apply if she becomes illegal, but it is not recommended since we do not know how long the deferred action application will be available. Besides, it is not recommended to become illegal whatsoever since the deferred action does not grant us legal status. As MIdreamer mentioned, I would recommend trying to get an employment visa, or even attend graduate school to keep her visa long enough for you to obtain citizenship in USA and sponsor her.

I really don't want my daughter do it.....

She came to USA when she was 14, she completed high school and entered collage here. but because of the company policy and I am not lucky, I am still file my PERM now. she can't apply the Green card with me...

she will try to find job and go through the process legally, I just want to know , if she can not find a job and wont marry with a guy for green card.

is the Dream act the last option for her?

She wont qualify for the dream act because she is legal. If she decided to overstay she will be over 21 and since she was legal before until she graduates she wont qualify
