College App-Legal Presence?

Okay, so the university I'm transferring to asks these three questions:

Are you a United States citizen? No.

If no, are you lawfully present in the U.S.? This would be yes? I know DACA does not grant us lawful status but we are allowed to be here for the time being, right?

If not a U.S. citizen, please provide your Alien Number: This is the number USCIS assigned us so if the school checks it then it would show that we are legally present??

I would assume so, ask your lawyer just to play it safe

Lawfully present yes, because the time we spent during DACA does not count toward unlawful presence according to USCIS's FAQ, even though we still don't have a lawful status.

Quote:

Q1: What is deferred action?
A1:Deferred action is a discretionary determination to defer removal action of an individual as an act of prosecutorial discretion. Deferred action does not confer lawful status upon an individual. In addition, although an individual whose case is deferred will not be considered to be accruing unlawful presence in the United States during the period deferred action is in effect, deferred action does not excuse individuals of any previous or subsequent periods of unlawful presence.
Under existing regulations, an individual whose case has been deferred is eligible to receive employment authorization for the period of deferred action, provided he or she can demonstrate “an economic necessity for employment.” DHS can terminate or renew deferred action at any time at the agency’s discretion.

DACA does not grant lawful status but it does grant lawful presence so say yes for the second question.

Re: College App-Legal Presence?

Put yes, because we have lawful presence (just not legal status). Do you mind telling us what state you are in?
