At the end of this video the reporter says that starting in March an illegal (i hate that word) can apply for a visa without leaving the US with a us citizen parent, spouse or child. is this true!?

But I think it also states that they will temporarily have to leave the US to pick up their visa... and in "some cases" it could be as little as a week. I'm not sure how that'll all work out but I'm sure we'll be hearing more about it in the upcoming months.

as far as i know, it is for those under 21.

i'm kind of in the same boat. i'm 29 and my mom is a USC. she filed an I-130 for me back in 2001.

i think right now it's for kids under 21 because then a visa would be immediately available to them when their parent becomes a USC.

I hope this really works out . Im 29 and my dad is a USC. He filed an i-130 for me back in 2007 and it was approved in 2008. My priority date should be in about 2 years.

was he a USC when he filed the I-130 or a PR? when is your priority date, if you dont mind me asking. and what is your category with NVC?

mine is April 30, 2001

from what i know, the NVC has 4 different categories. mine is F1 because i am a child of a USC over 21. currently the priority date for that category is july 08, 1993. and it moves about a week a month. :(

For the new Provisional Waiver you have to prove that you leaving the country for an extended period would bring extreme hardship for your immediate relative, eg spouse parent etc

my mom is also a usc and filed another 1-30 in 2011 i got about 5 years till my priority date becomes current.luckily i qualify for the life act so i wont have to leave to adjust my status.but for everyone else this would help you sooo much.
