Advance Parole for Work, Education, and possible Leisure?
 

Hello,

I was approved for the DACA and my home country is Mexico. I was given my work permit that is not valid for international travel, but then I heard about Advance Parole. I am currently employed at a leading insurance company and have been for 6yrs (how I was given this position without having legal status is beyond me, I would call it luck and God’s good grace). I hold a pretty high position at my firm but due to health care reform I may leaving the company soon. During my employment I graduated from Indiana University with a double major in finance and supply chain/logistics. My life dream is to attend the world cup in Brazil and I was wondering if Advance Parole would get me there without risking my legal future.

I will be applying for AP regardless of the world cup because all the logistic jobs that I will be applying for require international travel. My plan is to apply for AP with the special circumstance being employment related and educational which will be the truth as I plan to use my time in Brazil for more than just the games. I spoke to my lawyer and he told me that he has had clients that where approved for AP for lesser circumstances. My plan is to visit Brazil’s leading university Universidade Federal Do Rio De Janeiro to investigate their Master’s programs in supply chain and tour the campus. I will also visit one of my companies newly acquired subsidiaries in Brazil to see how the health care industry is in Brazil. My assistant will be traveling with me as he may be looking for future employment opportunities as well, he however is a us citizen. With my AP application I will be writing a full description as to why I’m going and will include two recommendation letters, one will be from my current supervisor and another will be from an experienced logistics consultant verifying that international travel is a necessity for my new Career path. I plan to be in Brazil for two weeks. I will arrive in Rio de Janeiro where I will spend the first week visiting the school and the subsidiary, the second week I plan to travel to natal to watch one world cup game.

Here Are my Questions:
My lawyer told me that they issue advance parole for 1 yr period where you can use it multiple times. Is this true? Or will I have to apply for advanced parole every time travel is necessary for my job?
I understand that advance parole isn’t for leisure but really I do want to investigate the career opportunities in Brazil as I am currently learning Portuguese and logistics is very big in the developing country. Do you think I will be granted AP?
Will customs ask why I traveled to Natal, Brazil when the subsidiary and school are in RIO and if I say to view a game after my work will that go against me?

When you apply for AP you must indicate if you'll be using it for multiple times and it will be valid for up to a year. Customs doesn't care where you went, they only care if you have the proper documents. You'll be using AP to travel to Brazil an you'll be staying only in Brazil I don't see any problems.

Wow! that's awesome. My lawyer will prepare these documents for a 500 dollar fee but after doing extensive research on this awesome cite (I just found yesterday) I'm starting to feel pretty confident about just submitting it myself. Do you think I can get it approved in the next couple month's or can I have it expedited?

You'll need evidence from the company that you will be traveling to Brazil; talk to them and arrange all that you will need. AP does take a few months to get approved (3 Months is the usual benchmark for most immigration processing), so it would have to be a date that is not so distant but reasonable enough to allow for processing (May/June timeframe IMO).

They rarely expedite it unless if it's an urgent humanitarian need such as a sick relative.

As for using a lawyer to process your application. Most of USCIS are straightforward, instructions are included, and anyone can just follow them and send what they ask for. IF you feel confident enough to do them yourself, go for it. Make sure to double check your evidence and make sure everything is right. It's not really an application for a green card or naturalization, if they deny you then you're not at risk for deportation or what not. And they always ask for more evidence as they need it. But to me, for $500, I would do the AP application myself. They would ask you for the same things and it could be something that you can just do yourself. That's my opinion.
