DACA and EAD denied - I will apply again
I'm about to apply for a SECOND TIME for a DACA and EAD.
-I originally applied in late 2012 WITHOUT a LAWYER or LEGAL REPRESENTATION -1 month later I did my biometrics and everything went well. -About 3 months after biometrics, my application asked for evidence (RFE), for school purposes and they gave me about 90 days to submit paperwork. -I submitted paperwork within 30 days -My application was denied 2 weeks later. Of course I qualified for DACA and EAD according to me, but the problem was that I did not end up going to school because of economic problems. It has been over 9 months since denial and I'm going to apply again, yet the applications makes you refer to the denial of EAD and Alien Numbers-should I provide those numbers I got from my first case? I am including a copy of the actual denial letter but the letter does not have my Alien Number (YOU GET an A-NUMBER ON THE RECEIPT OF THE APPLICATION) on it. Receipt numbers are both on the DENIAL letter and I'm sure they can link all of my documents just by getting this letter. I am currently in college, being in the USA for 10+ years living in California. I spoke to a famous lawyer in Southern California and the lawyer said I could apply again and that their office would like to help but their fee was $1,000 which is something I can't afford, I can barely sustain myself at this moment without a job. I, like a lot of people applying for this, have money issues for a lot of reasons and yet again I will try to apply by myself a SECOND TIME. Has anyone applied for DACA and EAD a SECOND TIME? Please Advise, every little detail helps and I'm sure it would help more people. Any suggestions and recommendations are welcome, even lawyers and helpers with experience on DENIALS. |

I don't really have anything to say except: make sure you really have what they are asking for before you spend more money.
I'm sorry to hear you got denied. I know how that feels because I got denied too, and I qualify for DACA. |

thanks, I think, just like you, that I qualify and meet all requirements just like I did before since I am a high school graduate in the end but I said I was going to attend college when applying and when I received RFE I wasn't in school because I was going to get fired if I decided to go to school and miss hours at work so I chose work over school. BAD DECISION. My mistake. I don't have a job and my very last savings is this money.

What did your denial letter say for the I-821D? You are a high school graduate, correct? You don't need to prove that you are currently enrolled in school if you have graduated already. What did you send for your RFE?
You need to get your transcripts from HS and college. But first, clarify to us what USCIS said you were missing and what you had sent specifically for the education requirement. |

For my application I sent certificate of completion and all my transcripts from all the way back to my elementary school certificate. I also sent a REGISTRATION RECEIPT (from my college) of classes for a future date. The letter asked RFE to provide evidence that I was "CURRENTLY ENROLLED IN SCHOOL-for MY COLLEGE" and that I had not submitted evidence showing that I was currently in school and that I also did not submit evidence showing what program or what classes I was taking. They did not take consideration for my high school completion. For the RFE, I submitted my COLLEGE schedule with future dates because classes had not started and my COLLEGE ID with my classes registration receipt. |

from what I understand, you dropped out of high school, needed money and did got your GED (aka "adult school) Can you explain what you said? I can also see why you got denied and you probably DO have all of the evidence you need but you sort/organized it super bad that got them confused. I dont think you need a lawyer, I think you post your evidence and let us tell you how it should go |

This time, I am including letters from principal validating this as a HS Equivalent from District and according to California Education codes. I did meet all high school requirements for a California high school graduate equivalent. For school evidence, I have new and sealed transcripts from my original high school and adult school (where I got the diploma) which also includes a certificate of completion and will add a letter from school principal and validation letter according to California Education Codes. Also, I am attending college, should I include my college information too since I am currently in school? Thanks! |
