Fake ssn and valid ssn
 
Hi guys,I
I have a situation that I don't know how to deal with. Last year I used a made up ssn to work, for about 3 months. It was a very good job and I made about $15000 in that 3 months. I was paid as a W2 employee. Now I have a valid SSN that was issued through EAD and I am wondering, how do I file taxes with my new SSN? The w2 from my employer obviously has the fake ssn. I have never had an ITIN as last year was the only year I really worked. Also, would I be able to get a tax refund?
Lastly, I am now in AOS process through marriage and I stupidly listed my employment last year on one of the forms. I am now tempted to not file at all but then USCIS knows I worked. I really don't know how to deal with the situation.
Any advice?

Go to a tax preparer, and file for all the tax years u have worked, to have residency you must file tax it's a condition of getting a green card

Lol idk why you worried I did it you just tell your tax preparer the number on the w2 isn't valid anymore you had an issue with it and they must use your new ssn and you putting you were employed on your aos I don't think it's an issue but idk I asked my lawyer before and she told me they just put a sticker onto your file but don't worry just file your aos and go freely don't panic

Thanks for the responses! I know a lot of people do it, am just a little scared. Plus when I talked to someone at IRS he told me that I need to change SSN with my employer first because if I file a tax return where my SSN does not match the SSN on the W2, the employer and I will be contacted to prove that the number actually belongs to me! This is not something that I want to go through especially while my GC is pending.
Otherwise, a lot of taxes were taken out and am owed a refund; I just want to do it in a way that won't affect me down the road

I have a question for you. Since you use the fake SSN, how did you file the I-9 form with the employer? Did you even file the I-9 at all ? Did you claim yourself as US cititzen on the I-9 form.

Be careful, the USCIS will disqualify you from AOS through marriage if they know that you claim yourself as US citizen on the I-9 form.

I did fill out an I-9 but never claimed to be a USC. I used my passport and I-94, IN MY NAME but I was never issued a social so I made up one where it asked for one.

If you didn't claim yourself as USC on the I-9, you'll be fine. A lot of people made up SSN to work in the past, and they still get approved for AOS through marriage. The USCIS generally will forgive you for making up the SSN since you're considered the immediate relatives ('spouse') of a USC.
