filing taxes. help
 
so my husband and I are filing taxes jointly but we are stuck doing it online because it asked us if me the wife is a citizen or permanent resident or a non resident alien. we clicked non resident alien and its telling us we can't file online because I need to file form 1040NR. has anyone stumbled upon this?

you are consider a resident alien for tax purposes

If you're an alien with a green card, meaning the U.S. Citizenship and Immigration Service allows you to reside in the country legally, you are a resident alien. However, if you don’t have a green card and spend at least 31 days in the U.S. during the current tax year and a total of 183 days during the last three tax years (inclusive of the current tax year), you’ll usually satisfy the physical presence test and are also treated as a resident alien.

Im tempted just click legal resident but Im not sure of the repercussions of that.....

I just filed my taxes and I'm a bit worried the government will come knocking soon. I work and live in New York City. I work on the books, and attend community college on the weekend. Of course I pay out of pocket. The lady who did my taxes said I qualify for education credits from the state and federal government, since I paid out of pocket. I got almost $3,000 back from the federal gov,and $804 from the state. I told her flat out I was not a citizen, or international student, I explain DACA to her, and she said I think you still qualify. I know many of you are students, who are forced to pay out of pocket. Did anyone else get education credits when you filed taxes?

so did you click "non resident alien" and did you do the 1040nr?
