My mom was stopped and charged for no ID. What steps can we take next?
My beautiful mom was pulled over today and not knowing her rights she spilled everything the officer was asking her. He asked her for ID. After she told him that she lost it and could not supply the ID. He started asking her if she was illegal, had drugs in the car. She told the cop that he could search if he wanted. She had nothing to hide. She trusted the cop and gave him all the info that he asked for. After the dude extracted all the info he then put my mom on the back of the squad car and she was taken to the station for fingerprints and to verify her identity. I'm being told that the officer kept poking at my mom telling her things like "You know we could transfer you to immigration for this right?" "You know that you could be deported and your childred would be taken to child protective services right?". She thinks that it would be ok to wait until the court date to fight. She believes that simply presenting the ID (she lost it at home.) will get her out of the situation, but I feel that there is more crap waiting to be thrown. Are the police able to deport my mom for this? I'm really upset and scared right now so I wanted to get your guy's opinion. She has 6 kids (including me). My sister and I being the oldest. We have Daca and the other 4 are under age born in the US.
Please help me. I dont know what to do. My mom is the sweetest person in the world and it really hurts hearing what went down. She's not a criminal. This is beyond unfair... |

What state are you in? If she has any sort of ID, I'm guessing she might have to pay a fine or even just pay court fees and be done with it, but if it were my mom, I'd talk to a lawyer familiar with immigration law ASAP.

Seriously, next thing you know she will be saying that because of the 6 kids shes on welfare and doesnt pay any taxes... People nowadays.

If you want to be careful and better safe than sorry, consult a lawyer. The police officer could have contacted ICE or something. Who knows?

Yea my mom was a rabbit... Single mom with no father support after he got deported 4 years ago. Not on wellfare. My sister and I help her get through. I'm currently looking for a lawyer so she can defend herself properly. This is all in Arizona btw.

I am so sorry your mom had to go through that! Same thing happened to my Mom and I drove to where she was and called my friend who is a cop in the area. He personally called the cop who pulled her over and he let her go. We still went to court and she just paid a ticket for not having her license on her. The cop was nasty and said horrible things to her. I understand she was at fault, but its another thing to yell at someone who is complying and answering all your questions and threaten to make their life miserable. Consult a lawyer, but I do hope it's just a ticket she needs to pay.

Telling her that CPS could take my sisters and that she could get deported for not having ID. It was a simple mistake. She kindly answered all the cops questions which was a mistake on her end, but regardless the dude could have been nicer about it. |
