Is it ok to fly with a pending DACA application?
 
My DACA has been under review since September 7th 2012. It's still with a background check officer.

Im planning on going to Arkansas next month to meet my bf's parents. I called ICE, DHS & USCIS and they'll told me they don't have any info on whether I can of not with a pending application just that I can't travel abroad for sure. They said I would need to contact the airline which I will be using. Is it ok to travel via plane with your DACA pending???

I would drive but its such a long drive!!!! 14 hours from Miami[/size]

As long as you have a valid passport or state ID/DL, you can fly. And it doesn't matter if the passport doesn't have an I-94 in it. As long as whatever form of government issued identification you choose to show to TSA, has to be valid.

There shouldn't be a problem flying even without DACA since TSA is the only agency that checks your ID. They don't check your immigration status. You should be fine.

Depends where you fly from. If you fly like me, from a border town (McAllen, Texas), the probability of being asked for a 'visa' EVEN if you show your passport, is extremely high.

Here's MY story...I arrived at the airport (McAllen, Texas), got in line, gave my passport and ticket to the TSA lady, she scanned it with no problems, then she handed it to the border patrol guy next to me, who checked to see if there was a visa and since it doesn't, he asked for it, and I gave him my work permit, he checked it, then he gave it back and let me pass.

Now, when I was flying back from Houston (IAH), I did the same with the TSA agent, but there was no border patrol next to her, so it didn't matter.

Again, that is MY experience flying from a BORDER town, so don't get scared or disappointed if this doesn't apply to you.

EDIT: I just read your from Miami, so I don't know anymore :p

Thanks for the tips! Worst case scenario if I do get stopped, they can't deport me or anything because of Obama's executive order for DACA right?
