Hey there,

I'm not eligible for the Dream Act as I was 22 when I moved to the US, but my girlfrield move to the US 3 months after she turned 16. I understand that you had to be 15 or younger to be eligible for the Dream Act, so I was wondering if there is some way around this.

PS: She flew here so she has an I-94 with her arrival date.

If she wants to try and has the money to do so, go ahead. It is worth a try but be prepared for a denial because more likely than not she will get denied.

I was wondering if there is someone here who tried that before and got lucky...

She won't get lucky especially with her I-94 record stating she entered when she was 16. Sure she can attempt to send an application but remember she does have to sign the below.

Not worth it, she might even get prosecuted for that as you are obviously lying.

The I-94 is a dead giveaway, they will background check you for sure. It's unfortunate but they set a line and your gf is on the other side. Tough situation.

Ok, thanks for your answers.
We weren't planning on lying but just hoping that USCIS could be flexible regarding her arrival date. :)

I don't think they will, rules are rules... Plus you will be $465 short since they will process the check first before dong anything...

geez all these people sound all negative and harsh but sadly they are right, I wish there was a way other people were able to qualify because I know how it feels to be in this country undocumented and two years ago all these people knew that feeling too. Dont lose hope hopefully there will be some light at the end of the tunnel for everybody :)
