DACA with a Dismissed DUI?
Hi,
I was approved for DACA in 2013 but in 2014 I got a DUI. In 2016 I got it dismissed but I know this will still show on my record. I didn't renew my daca because I was afraid I was going to get denied but now I am so close to graduating and I need a work permit so I am considering on giving it a try. I have never committed any other crime in my life, I'm a mechanical engineering student, I've done lots of volunteering work such as tutoring students with disabilities and elementary school children, I have received a lot of scholarships. This DUI was a really stupid mistake and there is not a single day that I don't regret it. I can't afford an attorney to re-apply so I will be just doing it all by myself. I've gathered all the paperwork from court already, letter of recommendations, transcripts, etc etc. I'm ready to apply again but I would like to know if I am still considered a criminal or if my case will be transferred to ICE if it gets denied? |

You've come to the right place to be judged, because here comes the wave of DACA recipients who are heroes and have never made a mistake before in their lives, and will be cheering for you to be deported. Because you give DACA a bad name, or some shit like that.
Anyways, it's hard to know what could happen. Under the new executive orders, i would imagine they will deny your DACA application because they can easily say that you are a "risk to public safety". But on the other hand, they already know who you are since you're already in the system, so why not give it a shot? You're pretty much rolling the dice here. |

Anything is possible. I would NOT go at it alone.
DUI very likely could disqualify you. Remember they exercise procedure in a case by case basis. You run huge risk, by submitting the application and also you run a huge risk by having committed the DUI and being out of DACA. These targeted deportations are going after DUI offenders, you could be next, no one knows. I suggest you get a good immigration attorney. Sorry you made a mistake that can have so many bad consequences. Thanks for sharing, hopefully people realize that this is no joke. Idk if I should be angry at you or.if I should be sorry for the situation you are in. |

To OP: There are many people that have been approved on dismissed/expunged DUI. From what I've read it comes down to your state and the discretion of whatever officer has your case. Just make sure that it is in fact expunged (or considered dismissed depending on your state). And most definitely use a lawyer you trust for this. It will be considered an initial application vs a renewal. Some resources for finding a good lawyer are AILA and Avvo as well. |

I would seriously get a good lawyer just in case the application gets denied. I honestly don't know if there is a possible good outcome in all of this. NOT with the current administration. |

Hey there,
I was in a very similar situation and i just want to share my story with you in hopes that it helps you a bit or at least provides some comfort that you are not alone. First of all, like someone said here before there are many sjwd (social justice warrior dreamers) as i like to call them in this forum that cannot take the fact that dreamers are humans too and may make mistakes, sometimes very serious ones that we of course regret. I got a DUI as well in 2013 about a year or so before i had to reapply for DACA at the time i was working in the tourism industry for a very large casino in a management position. My DUI was pretty uneventful and i was just at the legal limit after some drinks at a bar with coworkers and i thought i was fine to drive. I was pulled over and subsequently charged with the DUI i hired an attorney for about 10,000 to fight a lot of the fines and license suspension and to fight the charge itself. We got a lot of the fines reduced or removed and the license suspension shortened to only 3 months, the DUI charge remained though. I was of course worried that this would affect my DACA status and when it came to reapplying i hired an attorney to help me with the paperwork, and of course i had letters of recommendation made for me from coworkers, directors at my workplace, professors from college and so forth, along with letters from my local congressman (Republicans) urging that they look past my dui. I remember i paid close to 6,000 for this immigration attorney because i really wanted to give myself the best chance possible due to the DUI. Of course i could have easily done the application on my own like i did during my first approval, but this was much different case with the DUI. The DUI laws in my state are pretty strict so i was never able to dispose of the charge or get it expunged either. From what i read you got yours dismissed already. Ultimately my DACA was denied due to the DUI, and i lost my job, car, so forth and so on. It was one of the biggest mistakes i have made in life and it has of course affected me greatly, but i remain confident that I will succeed in life and keep pushing everyday to make the most of my current situation. I really do hope you succeed with your application, because i know the feeling all too well. Shit happens, and of course i feel bad that I have given dreamers a bad name in a sense. Also remember only God can judge you, not people on this forum, especially when you are asking for advice not to be judged. With Trump as president now I do worry about having ICE knocking at my door one day, but if it happens it happens and i will be ready. Just do not let people shoot you down for a mistake and keep fighting for you. |
