Can my family get U-Visa?
 

Hey guys, my family was thinking about filing for a U-Visa. I just wanted to ask to see if we're even eligible. Our place of business was robbed 10 years ago. I'm not sure if it's too late to apply now. Also, we weren't there when it happened but they stole about $50,000 of our jewelry and money and passports. The criminals were caught some time after. My family and I have an unusual case actually. My version of it is quite unclear as it was told to me by many people. We came here legally sponsored by my grandfather and so my parents and I received a social security card and we had work permit for a few years while our i-485 was being processed. And then I believe my dad was deported for some reason and he came back illegally and so that triggered the ban and then eventually our application was denied so now we're in this limbo. So my Dad does have a driver's license because he has a social security card and other docs that allow him to. So we were thinking the U-Visa would clear our status and allow us to adjust status or gain some kind of legal status? I apologize for my ignorance of how this all works. Any advice or suggestions would be much appreciated. Thank you.

There doesn't seem to be any qualifying categories for a U visa according to the story given. What you have described is "Burglary".

In addition, the story makes no sense concerning your father. I will caution, if your father was ordered deported the derivatives on the application are usually given the same!

There has to be physical contact done to your family and reason to believe the motive was racial hate.

You should probably consult with an attorney asap since u visas take such a long time. And every year, the wait seems to get longer and longer. I applied for a U Visa in December 2016, I expect my work permit in 2.5-3 years and the actual visa in about 5 years and resedency 3 years after receiving the U Visa. I think if you and your family cooperated with the investigation, then you might have a case, not 100% sure though.

Based on the story OP posted, he does not qualify for a U visa. No need to consult a lawyer.

Hi guys do you think i would be qualified for a u-visa, 9 years ago at the age of 17 i was abuse by a grown man, he broke my arm and i had a black eye, the neighbors call the cops and when they got there the guy was gone and the ems took me to the hospital after my xray they take me my room and a cop was there waiting on me he took a statement and i gave him all the info i know and he leave after that but the person was never cought and i never follow up with tge case because i was illegal, i get daca in 2013 and i went and get a copy of the police report so i was wondering if that could use as a case for u- visa and also i am ewi, i tried to get advance parole to clear my ewi but didnt get it, so wondering if i would qualify for a u-visa

Yes, you qualify! It actually sounds like felonious assault and you were helpful to law enforcement at the time of the incident.

I wish I would've known about u-visa a few years ago! My mom received a letter in the mail to her address threatening to throw ICE on my husband and I if we didn't resign from out jobs within a few days of receiving the letter. ☹️
