USCIS: Undocumented Parents
 
My fellow dreamers,

Many of us have undocumented parents and for those who have AOS interviews, or interview with an immigration officer for a court order or removal proceedings, how do you respond to questions about your father or mom?

For example, in AOS I've read that immigration officers can ask your wife or husband if they know your parents and if they know where they live. Can't they use this to go after our parents?

Similarly when we fill out paperwork for DACA, can't USCIS use this to get to our parents?

IMO I believe we should tell them the truth, because I do not believe they will go through the hassle to find out if they are legal. They do not know if they are undocumented.

But if they ask explicitly if they are legal, how do we respond?

Just something I wanted to bring up and discuss here.

In retrospect, couldn't the government also use information from DACA applicants to also enforce the law? USCIS and ICE are two different agencies, and from as long as I can remember, USCIS adjudication officers have only used the information to test the legitimacy of the marriage in question. They care a LOT more about the truth their questioning and evidence about the legitimacy of the marriage rather than if your current family has no paperwork.

He asked if my mom was a citizen or resident and I said no. He didn't say anything but typed some stuff in his computer.

That can be broad. He may think tps, or EAD of some sort.
