Should I just marry?
All this talk and no action is definitely making me get desperate!
I've had DACA since 2014 and renewed once (May 2018 exp date). For the past two years me and my fiancé have been procrastinating doing the whole marriage thing and adjusting status. Almost every time something gets in the way of our plans and we end up not doing it. This summer that passed we were getting ready to finally do it because we were scared a bit and we just had a baby too and fear of anything happening after the end of DACA was a big deal for us. But then we heard news about DreamAct coming along by Sept, then Dec, and now still no word until next month. All this talk and no action from congress about such a sensitive and important topic to us Dreamers is heartbreaking and a cause for anxiety. I want to get married ASAP because I just want to get this over with, but then I also want to wait on a relief for us too because Im EWI and I'm so afraid of not having enough evidence to prove extreme hardship other than financial, or that I do not know if I even have family members back where I'm from that I can stay with.. I've been in the US since I was 2 months old and never went back. All I know is the US and would be devestated and scared to wait for a visa or interview overseas somewhere I can't even call home. If they keep postponing this issue beyond January, is it even worth it to wait anymore? |

If I was in your situation, I would marry. I mean you guys already have a child and even if a bill is passed in January, I doubt it would be implemented by May.

No, he means that even if dream act passed, they wouldn't start accepting apps until May, and people wouldn't get whatever relief until the app is approved (aug+)

Got it. Guess I'll just do the marriage thing.
I'm just worried about waiting for a visa in my home country for a long time if 601a doesn't get approved. I came here when I was a baby just two months old on plane and never went back. I have no records of a visa when I came or any documents pertaining to that so I don't even know under what name I came with or anything. I rarely have family back home. Don't know if I would be considered a visa overstay or EWI. |

If I were you, engaged with a baby, I would just get married. No matter what happens with the DACA fix, being married won't hurt anything doing with that. Marriage has it's benefits, more than I can mention. But worst case scenario being married to a US citizen gives you a basis to fight removal proceedings and be granted green card if you win your case. Without being married to a US citizen, you have no case, so you are more easily deportable.

Imo, if engaged and with baby, there is a certain impetus and responsibility to act.

Help me understand, why are you hesitant to get married? You're in a stable relationship with a baby along the way but yet you have reserves about tying the knot?
Now assuming if you're both in it together and wish to start a family in the future, I would say don't wait any longer and get it done. However, if your significant other is still unsure and isn't really 100% about you then you have bigger problems you might need to consider. Good luck |
