Advance Parole Travel Risk
 
Is there a chance that my wife won't be allowed to get back into the country if she travels with AP? Our lawyer is advising her not to travel internationally. She has no overstay or anything in her immigration history. She was on f1 visa and later we got married and applied for AOS. She is now waiting for her GC with a valid AP and EAD combo card.

Could you elaborate a bit. Was she granted a GC and she's just waiting for it in the mail? If so, why can't you guys wait for her to have the GC?

Her GC is still pending. She'd be traveling with AP while her GC is pending.

There is always a risk. Hell, they can even deny entry to someone with a GC.

As long as she doesn't have any criminal record, she should be okay.

Practically speaking she should be fine. You can visit many forums where folks have traveled with their combo card while awaiting aos. Attorneys usually don't recommend traveling out of an abundance of caution.

ON the I-131 form they ask you to list the countries you plan to visit. Can she visit a country that wasn't on that list on the application?

You don't need to even fill out that part.

Do you know what documents she will need to present at the port of entry in addition to the EAD/AP combo card? AS far as we know, she will need to present EAD/AP combo card and her receipt notice for Adjustment Of Status application.

Passport and combo card.

No harm in bringing the I-485 letter either.
