Opinion: Possible DACA Supreme Court outcome.

Quote:

How the Supreme Court will rule is uncertain, but watch for a 4-4 split along the Court's ideological fault lines. Expect the four conservative justices, all appointed by Republicans (Justices Clarence Thomas, Samuel Alito, Neil Gorsuch and Brett Kavanaugh) to support the Trump administration's effort to end DACA, and the four liberal justices, all appointed by Democrats (Justices Ruth Bader Ginsberg, Stephen Breyer, Sonia Sotomayor and Elana Kagan) to vote against it.
Quote:

In that case, Chief Justice John Roberts will likely cast the swing vote, as he has done in recent blockbuster rulings, including some pertaining to immigration. Roberts, a nominee of President George W. Bush, has stalwart conservative credentials, but over time he has become more unpredictable and has sided with the Court's liberal bloc in high-profile cases. He stunned many by casting a decisive vote to uphold the Affordable Care Act in 2012, and in the most recent term, Roberts sided with four liberal justices to block the Trump administration's effort to add a citizenship question to the census in the absence of a legitimate explanation of reasons from the White House.

One of Gorsuch or Kavanaugh if not both is going to rule against Trump Admin on this. Remember that. And Roberts is definitely going to rule against Trump Admin.

Re: Opinion: Possible DACA Supreme Court outcome.

Last time Expanded DACA went to the Supreme Court, there was a 4-4 tie, with Kennedy presumably going with conservatives that President Obama had overstepped his bounds in enacting Expanded DACA and DAPA. I know the details were more complicated than that because Texas was saying that they had to spend a lot of money (not really) on two driver's licenses, but what it all boiled down to was that conservatives (With Roberts and Kennedy) Didn't think the President had such powers. If this same court with two extra conservatives on it heard the case again, DAPA, and Expanded DACA would have been shot down on the spot and you can bet immediately DACA would have been on the chopping block.

Now, DACA is going to SCOTUS not because Trump is trying to defend it against Texas - the exact opposite actually where Trump wants to end it. Now I'm not fancy big city lawyer but the SCOTUS was ready to shut down DAPA/eDACA when the Obama Administration was defending it with everything they had, it doesn't look too good that now they have a president who is wanting to get rid of it. About the best that has happened so far is that it's been tied up in the court and delaying the execution. Maybe there will be another stay on a technicality.
