Democrats Outline 'Plan C' for Immigration Reform

Sen. Bob Menendez, D-N.J., on Wednesday outlined Democrats’ "Plan C" push to include mass amnesty for millions of illegal immigrants in the budget reconciliation bill after prior attempts were rebuffed by the Senate parliamentarian.

Democrats have been trying to include some form of legal status for illegal immigrants in their budget reconciliation bill, which uses the process to avoid a Senate filibuster and pass the legislation with just 50 votes in favor. It could therefore be passed without a single Republican vote.

However, initial attempts to grant a pathway to citizenship for a number of groups of illegal immigrants were shot down by Senate Parliamentarian Elizabeth MacDonough, who said the push involves a "tremendous and enduring policy change that dwarfs its budgetary impact" and is thus inappropriate for a reconciliation bill.

A second effort, involving updating an immigration registry, was also shut down by MacDonough.

On Wednesday, Menendez confirmed to Axios that Democrats are trying again.

This time, they would seek expanded parole powers, which currently are to be used on a case-by-case basis for "urgent humanitarian reasons or significant public benefit" to grant legal status, including work permits, to an estimated 8 million illegal immigrants for up to 10 years.


"We haven't finalized it yet as we speak, but ‘Plan C’ would probably be a parole option that would give about 8 million of the 11 million undocumented immigrants who meet certain requirements the ability to work lawfully, to have a status that would last five years and would be renewable for another five years, that would protect them from deportation, that would allow them to travel domestically and internationally … that could also potentially gain access to healthcare coverage," he said.

Menendez said that they were currently in "deep conversations" with immigration advocacy groups to figure out exactly what the presentation to MacDonough will look like.

"I hope she will find her way to say yes this time, but we will not accept no as an answer at the end of the day," he said.

Menendez pushed hard for a sweeping immigration bill earlier in the year that would grant a pathway to citizenship for millions of illegal immigrants in the country, but it was shot down by a lack of Republican support, as it would have needed 10 senators to beat a filibuster in the typical legislative process.

Republicans are generally opposed to broad amnesty provisions, but even those who had been open to some limited pathways said they wouldn’t consider such a move until the crisis at the southern border has been solved.

Menendez on Wednesday acknowledged the political realities facing such a push and said that reconciliation is "the only pathway for some broad-based pathway toward some type of status for undocumented immigrants in the country."

"And without reconciliation and without Republican support in an evenly divided Senate, I don't see how that pathway would be possible," he said. "That’s why we’re putting so much effort into this."

LOL what they are trying to do is create something that is too big to fail. If this gets approved and 8-11 people gain work permits, have legal employment, and pay taxes... it would become too big to end after 10 year. Imagine, all those people dropping out of the workforce all at once. It would push the economy into a recession. They are trying to tie immigrants to the economy, medicare/medicade, and SSI...

As far a long term plans go... it not bad.. it would force the GOP to choose between the sustaining the economy or deporting millions of people

But due to the scope, i think it will get rejected.

I have no idea where this arbitray 10 year number comes from. Why only let us renew once? Why not make a permanent parole program. Or better yet overrule/fire the parliamentarian.

They're always trying to legalize too many people at once...
That was one of the Parliamentarian's arguments for objecting to the inclusion of any immigration benefit through the reconciliation process.
The scope and size of the thing.

Either (A) Democrats can't read
or
(B) They know plan "C" is a loser plan but will push it anyways. The Parliamentarian, of course, shuts it down. Then, they walk away with a "valid" excuse to give justification to their failures.

I think it's "B".


Man, I wish we had money like gay people do.

Look at how they got their shit done.
Everybody hated gay marriage back then. Some people still do.
They couldn't get gay marriage done through legislation in most states so gay people litigated, shoved and forced the damn thing through the judiciary's throat and it became the law of land.

This happened despite the damn thing being so unpopular that literally almost every single state of the union failed to pass gay marriage through legislation.
