Hanen Ruling on DACA Program
 
As expected, Hanen has ruled the DACA program unconstitutional. Renewals remain in place as the case will now go to the 5th Circuit for further consideration. Would appreciate some input from the legal heads on here as to what this means for continued renewals.

Hanen is keeping DACA intact for current recipients, allowing the government to process renewal requests.

Based on past cases I think we can expect a last 2024 to early 2025 SCOTUS ruling

I believe the fifth district courts can rule in our favor this way we can avoid the Supreme Court!

DOJ should just wait a long time to appeal lol

Or would the suing states appeal first

Below is our predicted timeline for how DACA will likely continue through the courts:

1. June 1, 2023. Judge Hanen hears oral arguments on Texas vs the United States on DACA.

2. Assuming a negative ruling, this case will return to the Fifth Circuit Court of Appeals and they will likely hear the case sometime between the early spring to fall of 2024. The Fifth Circuit would then issue a decision; a negative decision could include removing the current stay on renewals, meaning DACA renewals would be halted. The Fifth Circuit ruling regardless of the decision, will likely be appealed to the Supreme Court.

3. It is possible that the Supreme Court takes this case for the 2023-2024 session, but due to the estimated timeline, the Supreme Court will likely not have the option to take the case in time for the Spring 2024 session, meaning the earliest the Supreme Court court rule on this case would be in the Spring of 2025
