Daca initial application mistake
 
Hey guys, I have a question/doubt that recently came back to haunt me. In 2021 I sent in my initial daca application. When I was sending my package I went to take a photocopy of my Mexican consular id. I sent the package & then a week later I realized I still had the fak* mica (mica= green card) in my wallet. I panicked & thought I might’ve sent that by accident. (I did have my consular id on me too.) I don’t (hope) think I could’ve been careless enough to send that. But I do doubt it. My application went forward & I eventually got my biometrics info & went for my appointment. Nothing happened since a week later haven shut down the program. I’m terrified of the thought that Uscis might have that on me & could potentially ruin any chance I have of future immigration relief. My question is, would uscis have let me know that I submitted fraudulent documents by now if I indeed did? I’d appreciate any response guys, I’m not gonna lie, the thought recently came back to my mind & just has me messed up.

I feel like they would have seen it and denied your application outright. You should look at your USCIS account, they post PDFs of all the documents you submitted after they’ve been scanned into the system.

How do I go about doing that? Do I Just link my Uscis account to my case #? I was never accepted since a little over a week after I did my biometrics the program shut down for new applicants . Do you mean a FOIA request? Thanks for your reply

I spoke to some people on the daca Reddit & they said Uscis doesn’t check the package until after biometrics which kind of doesn’t make sense but I’m no expert here. I’d think they at least verify who you are through Id, but this is just hopeful thinking from me

It has been a very long time, but I recall using the https://egov.uscis.gov website to create an account and link my case to it. I was able to see all the scanned documents with markings on them. I am unsure if that’s still an option anymore.

As for Reddit, doesn’t make sense for them to wait until biometrics are completed. How would they know who to issue the acceptance (or bios) notices if they don’t know who the case belongs to?

Do a FOIA and see what you submitted actually. That being said - using a fake green card wouldn't be a factor for DACA, it's also not an inadmissibility unless you are seeking admission on a fake document (in case of which it'd be misrepresentation).

Admission as in entry to the country?
And yeah, I did a FOIA a couple days ago. I’m kind of overthinking it cause common sense says they would outright reject my application had I done such a thing. But they had my application for 4 months all the way till I did my biometrics. Then Hanen placed the injunction & I got nothing.

Yes, for the most part at least, it is possible to make yourself inadmissible by for example claiming to be a permanent resident and try to procure some other benefit (e.g. file an I-130 for a spouse under false pretenses).

Still to err on the side of caution if it did happen (you did send them a fake green card) the best thing you can do is basically write to the center that has your I-821D and I-765 and write that you wish to withdraw the application and any statements made in connection to it since one way to get around being found misrepresenting is a timely retraction. It can be as simple as "I wish to withdraw my applications, and any: statements, attachments and exhibits submitted".

Not like those will ever get approved anyways unless DACA is codified into law and down the line it'll be easier to argue that you timely retracted rather than argue that it wasn't material.

So do you think it’s possible that they didn’t check my identity & just let me go through the process all the way?
Surely they do an initial review to establish eligibility to the program. Would they not have caught it then? I got all the way through the process & did my biometrics.
