Washington, D.C. – Today, the U.S. 5th Circuit Court of Appeals’ decision regarding the future of the DACA program officially went into effect. We do not yet know if and how the Trump administration will follow this ruling.

Just days before Donald Trump’s inauguration, the U.S. 5th Circuit issued their ruling that would allow for first-time applications to be adjudicated across all 50 states, including Texas. Their January decision also included details specifying that access to work permits would be removed from tens of thousands of DACA recipients in Texas specifically. With the decision now mandated, immigrant youth remain unapologetically unafraid of fighting for their freedom to stay in their homes and their communities.

Bruna Sollod, Senior Political Director of United We Dream, said:


“For years, immigrant young people and our allies have taken to the streets and courts to fight back, to demand first-time applications re-open, and that DACA be expanded to all eligible young people. There is no doubt that today is a historic moment with first-time DACA applications having the opportunity to re-open across the country. Today should be a day where we can celebrate unapologetically and without hesitation. But we are under no illusions. Donald Trump will continue with his agenda to target as many people as possible to mass abductions and indefinite detention.

We urge DACA recipients to renew and speak to a trusted attorney for support now. There are no guarantees that Trump won’t still try to end DACA, but no matter what, we know that the majority of the American people support immigrant youth and the DACA program. Whatever comes next, we are ready and will stop at nothing to protect our communities and fight for the future we want.”

Wait what!?!? I live in Texas , so my work permit will be revoked, like immediately???? What!!???

To first time applicants,

Some people are saying not to apply because they would be giving their info to the Trump Administration.

"if you are thinking of applying for DACA for the first time do NOT do it now. Speak to an immigration lawyer before submitting anything."

Would you take the risk?

That was a common advice back when the whole thing started. That we would be turning ourselves in essentially. I think that no matter what they should apply. Just the chance of getting protection from removal and a work permit is worth it.

I read that in Texas deportation protection continues, but not work permits? But details aren't very clear.

I will say, if they decide to apply, they must ensure they meet all qualifications without any doubt. Any rejected applications will result in being sent to court for removal proceedings.

This is a new procedure implemented by the administration for all immigration processes. Falling out of status due to a denied application will lead to immediate removal.

What exactly is the point of not having a work permit? Would people just move to a nicer state? i.e relocate to Nebraska lol.

Wouldnt this cause a gain of productivity elsewhere and a loss in Texas? DACA arent eligible for any bennies or assistance, no matter how many times they wrongly repeat it.

According to available data, Texas has around 106,000 DACA recipients. $40K per capita average income.
$4, 134,000,000 so $4B damn, talk about blowing a hole in the state economy for no reason.

Most likely TX EADs will expire without being able to renew

Adding that according to UWD for Texas DACA recipients --> 'depending on what the Trump administration does next, the decision to separate work permits from deportation protections for DACA recipients and DACA eligible young people in Texas would go back down to Judge Hanen to determine when/how this takes effect.'
