my case has been refused(i think?)
ok so i went through the I-130 and sent in everything I was supposed to. We had our appointment and when we went to the appointment they asked my husband if he had entered the U.S illigally. He told them that he had only come in once and that was so that we could get married and so he could see his son be born. He left out the fact that when he was around 15 years old he attempted to enter the US and was caught, they took his finger prints that day and was sent back.
The official asked him to tell him if he had entered illegally and he told them when but i didnt think it made a difference as to what you do when you are a minor. Anyways they then proceeded to tell him that he could try again in six months to tell the truth. Does this mean that I need to fill out the same paperwork again in six months or does he get another appointment? do i need a lawyer. i need some help because they basically told him 6 months now get out and never gave him a clear answer as to what he should do next. HELP! |

I think the next step is a waiver form I-601 but don't take me 100% on it
hopefully someone else on the forum will have a more clearer answer for you. |

ive been trying to read around and it seems like that might be what i would have to do. when i fill it out do i send it to where he had the appointment or to the uscis address?
also i have been thinking about contacting some higher ups because this is rediculous! i am now a single mom. i cant afford all of these high costs! who would u recommend I contact? |

Sandra the best thing you can do is look in your area and see if there are people that are certified in immigration consultation. In many law firms you can call and set up an appointment which most the time the first one will be free but not all offer that so make sure you ask before you go and then personally take your paperwork so the person certified to give legal immigration advice can look and give you an answer. If the case would have been denied they would have told you so right then and there.

Sandra..I recommend you find a good attorney. Use www.martindale.com to find an immigration attorney in your area.
It sounds like USCIS is going to deny the case. You can file the I-601 waiver but its best if you use an attorney from here on. |
