That isn't their strategy, they know they won't be able to amend the constitution. They will write a bill that denies it at the federal or state level. Naturally, this will spark a lawsuit. Then, they hope that with appeals it goes to the Supreme Court and since it is still conservative leaning, they then believe Scalia Thomas Roberts and co. will strike it down
