EWI have to leave the country and enter legally, activating the ban, however, there may be a hardship waiver that can apply if you can prove that the person needs to be home, i.e., have a child or something.

Overstays can adjust in the country

The whole marriage for greencard thing is something very serious, I would have to hope the other person does not mess anything up or she is deported and banned for life and I have a major fine and a lengthy prison sentence, that transcends any kind of offer they could give. In order for me to take such a risk I better care about the girl, not only that but we are not talking about a minor commitment.
