you will find that cases are won almost all the time based on the First Amendment. You can even have signs that say "Thank God that you are dead" at soldier's funerals, you have follow a specific way of doing it but you can still do it.
Remember those people who called AZ's SB1070 racist? (many of us in here also) According to your logic then, they all should be sued right? Remember the white Russian Dreamer from Michigan? (it was in the news) If he was caught in AZ, he would be treated differently somehow (compared with, say a Mexican Dreamer)? If that actually happened then indeed, SB1070 is racist, or else sue sue sue, according to you. There were so many people calling SB1070 racist, it was ridiculous.
