Your employer and you will have to retain a lawyer to handle the process. Have you talked to a lawyer yet?
The Unskilled visa category is backed up at the moment so be prepared to wait a while. At the moment, cases with a priority date for 2004-2005 are being processed.
Make sure to talk to a lawyer before doing anything else.
