I may be going out on a limb here, but I firmly believe that an I-94 makes a huge difference because it officially establishes your entrance into the country. Corresponding to my name and my passport, there are no departure records for me for out of country traveling.

Doubt it. I'm sure an overstay could just as easily try to go back and return EWI style. Idk just a thought.
