Well..this is some clever lawyer trick. They think. Gay rights, including right to marry, immigration-sponsorship, etc, is a matter of equality, and very different from the principle of CIR, in that a person's gender orientation is inherent, not voluntary as it is with immigration/emigration. I think this will be decided by the courts, as it should be.
