There's already been a class action lawsuit filed in federal court in Washington regarding issuing interim EADs: https://www.bloomberglaw.com/public/...ens?1470100709

Not all plaintiffs in the class are DACA applicants but the thrust of the lawsuit is the same: you need to issue interim EADs if you can't process in time.
