Hi there, I also had a background check issue as in it was delayed at the FBI. I did my biometrics on 6/13/2016 and my senator told me that I passed the background check on 9/26/2016. And I was finally approved today, so it was around a little less than a month after I cleared the background check that I was approved. However, every time I asked the tier 1 or 2, they said my background check didn't pass yet even though it did. So even though they said your case is still pending background check, it might have passed. Contact your senator and she/he might give you more information than just contacting USCIS. Keep your hopes up!
