"In the enforcement memo, it's described that DACA recipients are excluded from this enforcement priority, but in reality we know that's not the case. Any DACA recipient who falls within any of these categories of suspected crime, reasonable suspicion to be in certain circumstances, is still going to be subjected to removal," Eaton said. "The DACA recipients are as vulnerable as anyone else, under the broad language of this memo."

For anyone who has read the memos from yesterday, it's obvious they are purposefully ambiguous. They "leave DACA alone", yet we all fall under the 7th priority for a removable alien (in the judgment of an
immigration officer, otherwise pose a risk to public safety or national security). This is up to the discretion of the agent. It'd be really hard to prove otherwise if he accused you of something you didn't do. IMO, this is what we should be looking at:

Quote:
They're defining a removable alien as anyone that an ICE agent has any reason to believe -- it's a very low standard -- might be in the country undocumented."
Further, I am not sure if anyone has noticed section I, No Private Right of Action, in the memo. It essentially states they can use your DACA info to deport you, whenever they decide to do so.

Quote:
I. No Private Right of Action
This document provides only internal DHS policy guidance, which may be modified,
rescinded, or superseded at any time without notice. This guidance is not intended to, does not,
and may not be relied upon to create any right or benefit, substantive or procedural, enforceable at
law by any party in any administrative, civil, or criminal matter. Likewise, no limitations are
placed by this guidance on the otherwise lawful enforcement or litigation prerogatives of DHS.

We should be cognizant that while we do still have our work permits, as it stand, our deportation protections are easily stripped if the agent feels like it. There's no guidance for the agent so it'll be really hard to fight like we are seeing it happening for the dreamer in Seattle.
