USCIS and ICE are two different agencies, and from as long as I can remember, USCIS adjudication officers have only used the information to test the legitimacy of the marriage in question. They care a LOT more about the truth their questioning and evidence about the legitimacy of the marriage rather than if your current family has no paperwork.
